A single bench of Justice Mahesh Sharma Poudel ordered Prasai to appear through the Attorney General's Office with a written response including the reasons for his arrest. In Prasai's case, advocate Ashish Luitel had filed a habeas corpus petition.
Prasai was last arrested from Birgunj on Monday night. The court had extended his remand for 3 days on Jestha 5. The police had obtained permission from the Parsa District Court to extend the remand for investigation against him under the Electronic Transactions Act and offences against the state.
The police claim that Prasai's statements made through various media outlets and social media are such as to spread hatred and malice against public decency, affect caste and communal harmony, and create contempt for the government.
Prasai was arrested from Siddhartha Diyalo Hotel in Birgunj by a team deployed from the District Police Office and Ward Police Office, Birta.
