Proposed Chief Justice Manoj Kumar Sharma has said that the responsibility of registering a writ or forming a bench lies with the Supreme Court administration and that he has no hand in it.

During a parliamentary hearing on Tuesday, Sharma said, 'Rather than forming a bench on my order, the administration will do it. The administration must have done it at its own discretion. I have no comment on this.'

The Supreme Court administration has disobeyed the order given by Acting Chief Justice Sapana Pradhan Malla to register a petition against the order to form a bench against the recommendation of the Chief Justice. Malla ordered the application to be registered on Monday, but the Supreme Court administration has not complied with it yet.

 

The Constitutional Council had recommended Supreme Court Justice Manoj Sharma as the Chief Justice, breaking the tradition of recommending on the basis of seniority.

Senior advocate Dinesh Tripathi and advocate Premraj Silwal filed a writ petition on April 25 against the council's decision, but the Supreme Court refused to register it.
