The past tradition has been broken in the recommendation of the Chief Justice of the Supreme Court. The Constitutional Council used to recommend the senior-most judge as the Chief Justice. But the Constitutional Council, led by Balendra Shah, has recommended Manoj Kumar Sharma, who is in the fourth rank of the Supreme Court, as the Chief Justice.
Above Sharma were Sapna Pradhan Malla, Kumar Regmi and Hari Prasad Phuyal. Earlier, the Parliamentary Hearing Committee had rejected the name of Deepak Raj Joshi. He was recommended by the Constitutional Council.
Recommendation for Chief Justice Manoj Kumar Sharma
After the retirement of the then Chief Justice Prakash Man Singh Raut, Sapna Pradhan Malla has been leading the Supreme Court as the acting Chief Justice based on seniority.
The court practice that began with the Chief Justice in 2008 is about to get its 33rd leadership by 2083.
The parliamentary hearing committee will hold a hearing after the recommendation of the council. After the committee approves the hearing, the President will appoint him as the Chief Justice. The hearing will take some time.
