Law Secretary demands resignation of Labor and Administrative Court judge

The government has asked the members of the Administrative Court and the Labor Court to resign. Law  Ministry Secretary Parashwar Dhungana had called them on Tuesday and made this request. Law Secretary Dhungana also admitted that he had requested them to pave the way as the government had appointments to make. He said that he was only doing his job of conveying the government's message. 

The resignation of the members of the two courts was demanded after the conclusion that the recommendation made by the Judicial Council was not suitable. 

The resignation of Nawal Kishore Yadav and Alok Chandra Shrestha, who were appointed as members of the Administrative Court, has been demanded, while Law Secretary Dhungana called Shailendra Kumar Chaurasia and Kumari Kharel, members of the Labor Court, to pave the way. A member of the Administrative Court admitted that he had received the call and said that they were in discussion about what to do. 

After the members of the two courts received the call demanding their resignation, they asked the judges of the Supreme Court what would be appropriate. According to a Supreme Court judge, they had sought advice on whether it would be better to stay for the period given by the government or resign and leave after the government asked for it. The judge said that he had suggested that the appropriate decision be taken after consultation. 

After the formation of the government led by Balendra Shah, the appointments in other areas were revoked by ordinance. The resignations were demanded in the Labor Court and Administrative Court, not by ordinance. They were appointed during the previous government. 

Tek Bahadur Ghimire is the chairman of the Administrative Court in consultation with the Judicial Council, while High Court Judge Janak Pandey is the chairman of the Labor Court. Nothing has been said about them so far. 

The Administrative Court has been given the jurisdiction to decide on disputes between civil servants. It is within Singha Dabar. The Labor Court hears disputes between workers and industrial establishments as per the Labor Act.
