Attorney General Narayan Dutt Kandel has suggested that President Ram Chandra Poudel issue the ordinance immediately as the constitution does not give him the right to stop it. He made this suggestion after reaching Sheetal Niwas after President Poudel sought his opinion on the ordinance.
The government had recommended six ordinances, including the ordinance on the Constitutional Council, from Tuesday to Wednesday, based on Monday's cabinet decision. The president has issued an ordinance on cooperatives, while others are under legal consultation.
Attorney General Kandel told Kantipur that the president should act under the authority of Article 66 of the constitution and advise that the ordinance recommended by the cabinet should be issued without going into the subject matter.
'The president had called for a consultation on the ordinance. I said that the president should not enter into the subject matter,' Kandel said, 'The president's chief advisor is the prime minister. The legal advisor is the attorney general. I have given my opinion that whatever the Council of Ministers has recommended should be issued as is. ’
He said that he had suggested that the President should act in accordance with Article 66, Clause 2 of the Constitution. Article 66 of the Constitution mentions the functions, duties and powers of the President. Clause (2) of which states that ‘In exercising the powers or performing the duties under Clause (1), any other act to be performed by the President, except for the act expressly provided for in this Constitution or the Federal Law to be performed on the recommendation of any body or official, shall be performed with the recommendation and consent of the Council of Ministers,’ and such recommendation and consent shall be submitted through the Prime Minister.
