The Nepal Bar Association, an umbrella organization of legal professionals, has requested the government to immediately withdraw the ordinance.
In a statement issued on Wednesday, Bar General Secretary Kedar Koirala claimed that the government's decision to bring the ordinance is against constitutionalism. 'The act of promulgating the ordinance by postponing the rare practice of using the ordinance temporarily as an exception and then issuing it again after the regular parliament session has been called and deceiving the people's representative institution, the federal parliament, will attack parliamentary practice and the essence of the constitution and promote arbitrariness,' said the bar. 'Such actions are against constitutionalism. Therefore, we demand the Nepal government to immediately withdraw the ordinance.'
The bar has commented that the ordinance was submitted to the President by the government of Nepal after the election of the House of Representatives was held on 21 Falgun 2082 and the federal parliament is the representative institution of the people.
The Bar has commented that only laws inspired by the federal parliament and parliamentary process, which have gained public trust and are the place of exercising sovereignty, will be universally acceptable and long-lasting.
The Bar has also requested that people's representative institutions, parliamentary methods and processes be always respected.
