The Patan High Court has issued a short-term interim order on a writ petition filed seeking to stop the screening of the movie 'Lali Bazaar'. A single bench of Justice Prakash Dhungana issued the short-term interim order along with a show-cause order.
Roshni Nepali had filed a writ petition on behalf of the Badi community demanding to stop the screening of the movie.
The film directed by Yama Thapa was in preparation for screening since 18 Baisakh. The film, produced by Shatkon Arts, is based on the story of the struggle of women from the Badi community.
The 'premiere show' of the movie 'Lali Bazaar' was being held this evening.
The court has already ordered the government to act in accordance with the constitution and prevailing laws as it is against the constitution of Nepal to screen films containing words and images that hurt the dignity, honor, reputation and self-respect of people of the community and spread communal ill-will, and has also issued a temporary order to do the same in the writ petition filed by Lali Bazaar. The court has banned the screening of the film until 22 Baisakh.
The court order states, '...in view of the fact that a directive order has been issued in the name of the Film Board and the Film Censorship Committee to effectively play a regulatory role within the scope prescribed by the Constitution of Nepal and prevailing laws to control the screening of films containing words and images that hurt the dignity, honor, reputation and self-respect of the people of the community, such as those that incite hatred, enmity or hostility towards anyone, and to maintain control over the screening of films containing words and images that cause communal ill-will, as per the provisions of the Constitution of Nepal and prevailing laws, the issues raised in the writ petition are likely to cause irreparable harm to the petitioner as well, and therefore, on the basis of balance of convenience, a short-term interim order has been issued in the name of the respondents pursuant to Rule 42 (1) (a) of the High Court Rules, 2073 BS, prohibiting the screening of the film 'Lali Bazaar' in public till 22 Baisakh. Please inform the respondents of the present order.'
