The writ petition filed by advocate Madhav Kumar Basnet, including the Office of the Prime Minister and Council of Ministers, was filed earlier. The Supreme Court administration filed the writ petition after also making the Chief Justice a defendant. The writ petitioner had filed a new writ petition, removing the defendants. On 22 Chaitra, Prime Minister Balendra Shah appointed Kandel as the government's legal advisor. The writ raises questions about Kadel's constitutional qualifications.
The petition claims that Kandel's qualifications do not meet the requirements of Articles 157(3) and 129(5) of the Constitution of Nepal. To be an Attorney General, one must have practiced law continuously for at least 15 years. The writ claims that Attorney General Kandel does not have continuous legal experience.
