A petition seeking to file a contempt of court case against Prime Minister Balendra Shah has been filed in the Supreme Court. 

The petition was filed before a bench of Justices Hari Prasad Phuyal and Shantisingh Thapa. Shah had filed a petition for permission to file a contempt of court case on 3 Baisakh 2083 after becoming Prime Minister. A hearing is scheduled to be held on whether to grant permission to file a contempt of court case in the said petition.

Advocate Barsha Kumari Jha had filed a contempt petition on 8 Asar 2080. Immediately after taking the oath of office as an MP at Singha Dabar on 12 Chaitra, Shah had received a date from the Supreme Court in the contempt case. He had gone to get a date as he was ordered to appear in person. The filing of the case was scheduled for 14 Jestha, but he had filed such a petition before that. 

Three years ago, a contempt of court case was filed against Shah's statement after the Patan High Court issued an interim order against the cinema hall operator not to stop Hindi films. Advocate Jha had filed a contempt case, alleging that he had insulted the court and government by linking it to neighboring and friendly country India through social media.

In that case, a joint bench of Supreme Court Justices Ishwar Prasad Khatiwada and Hari Phunyal had asked him not to file a petition and to appear in person.

Shah himself had appeared in the Supreme Court because the Supreme Court had asked him to appear in person on the date of the case. At that time, Shah had said, 'When it comes to the sovereignty and independence of the country, I will not respect any law or court. After the film writer said that Nepal was under the rule of India, their intentions are clear. The Nepal government calling this a stunt and the court allowing the film to run were under the rule of Nepal-India, it is understood that the court and the government are slaves of India. "I am ready to face any punishment for this, but the film will not be released and will not be allowed to run," he wrote. The petition argues that this is contempt of court and should be punished with imprisonment and a fine.
