In the writ petition regarding the dispute over the legitimacy of the Congress, the Supreme Court has ordered the party led by President Gagan Thapa to give notice of the hearing regarding the registration of a new writ (on 26 Chaitra) and to hold another hearing simultaneously.
The bench of Acting Chief Justice Sapana Pradhan Malla and Justice Meghraj Pokharel has made this order saying that the arguments of Thapa's party should also be heard before deciding whether to issue an interim order.
On 26 Chaitra, the party led by Sher Bahadur Deuba had filed a supplementary application demanding to stop the agenda of the regular general convention. The demand of Deuba's party was that the previously registered writ should also be considered simultaneously. However, the Supreme Court has called both the parties for discussion, saying that an interim order will not be issued unilaterally.
On 4 Magh 2082, a writ was filed against the decision to grant Gagan Thapa the legitimacy of the party. The latest writ petition has demanded that the new schedule of the 15th general convention not be implemented until the dispute over the party's legitimacy is resolved.
After the party's Gagan Thapa faction started preparing for the convention, the Deuba faction had demanded that it be stopped.
In the previous writ petition, the then general secretaries Gagan Thapa and Bishwaprakash Sharma had claimed that the leadership was elected unconstitutionally by holding a special convention despite the disagreement of the party's president, and demanded that the new working committee should not be recognized and that the Election Commission's decision be nullified.
However, the Supreme Court refused to issue an interim order and only called for discussion. On 6 Magh, a bench of Justice Sunil Kumar Pokharel issued a show cause order and granted priority. Then, the hearing scheduled for 1 Chaitra was postponed as it was not possible to attend, and then it was postponed by the court itself on 22 Chaitra.
