On Magh 4, 2082, a writ petition was filed against the decision to grant party official status to Gagan Thapa, while on Chaitra 26, a petition was filed in the Supreme Court demanding that the new schedule of the 15th General Convention not be implemented until the dispute regarding the party's official status is resolved. The court is going to hear both the petitions together.
After the party's side of President Gagan Thapa started preparing for the general convention, the Deuba side has demanded that it be stopped. They did not file a separate writ petition but filed a supplementary petition in the dispute filed earlier.
In the previous writ petition, they claimed that the leadership was elected unconstitutionally by holding a special general convention led by the then general secretaries Gagan Thapa and Bishwaprakash Sharma despite the disagreement of President Deuba, and demanded that the new working committee should not be recognized and the decision of the Election Commission should be nullified.
However, the Supreme Court refused to issue an interim order and called only for discussion. On Magh 6, a bench of Justice Sunil Kumar Pokharel issued a show cause order and granted priority. Then, the scheduled presentation on Chaitra 1 was postponed as it could not be seen, and then it was postponed by the court itself on Chaitra 22.
After the pending case was not heard in the court, the Deuba side filed a supplementary petition demanding that the regular general convention activities be stopped. If the Supreme Court issues an interim order after hearing today, the work of the regular general convention may be affected. If the interim order is not issued, there will be no legal hurdle in the preparations for the general convention.
