The Kathmandu District Court has issued an order to release Lumbini Provincial Assembly member Rekha Sharma from custody.
The court has ordered her release from custody, saying that the charge of torturing and enslaving a domestic worker has already been decided not to be proven. The bench of Judge Jagat Bahadur Poudel refused to keep her in custody further, saying that the Attorney General's Office had decided not to prosecute the case on 16 Jestha 2082 and that the decision was in accordance with the law.
Lumbini Provincial MP Rekha Sharma was arrested on 16 Chaitra. Elected from the UML, she was arrested from Dhumbarahi in Kathmandu. The District Court had presented her for an extension of time for investigation into crimes against children by keeping a minor as a domestic worker. A few years ago, a girl was rescued from her house by the Kathmandu Metropolitan City.
The then Kathmandu Metropolitan City Mayor Balendra Shah wrote about the girl on his Facebook wall on 29 Magh 2081, 'Sari Nanu! The government has decided not to prosecute your perpetrator. Don't panic. "The time will come," he wrote. He also mentioned that "to eradicate such discrimination, crimes and bring those who commit such crimes to justice, you and many other children like you should study. Society should understand."
But the district court, looking at the documents attached to the case, ordered the release of the victim, saying that she was continuing her education and playing the role of a guardian. After the district court's order, Sharma should now be released from custody.
