The Sushila Karki-led government decided on March 14 to make ‘special arrangements’ for Ekta Shah’s admission to MBBS. Shah is a victim of the Gen-G movement.
After Balendra Shah was appointed Prime Minister, Education Minister Sasmit Pokharel and Health Minister Nisha Mehta started urging the Medical Education Commission to implement the decision. After continuous urging, the Commission’s meeting on Wednesday approved the decision of the Council of Ministers.
‘The chairperson (Prime Minister) was not present at the meeting of the Commission. The decision was passed in the presence of the co-chairpersons (Education and Health Ministers),’ said a member of the Commission. ‘Even if the Council of Ministers decides, the decision of the Commission will not be implemented until the chairperson signs it.’ He said that the decision made by the Council of Ministers of the previous government was presented as an agenda in the meeting by the Commission after pressure from the government.
Education Minister Sasmit Pokharel and Health Minister Nisha Mehta were present in the meeting. This decision is currently being criticized.
The Council of Ministers had decided to provide an additional scholarship quota to Shah from Sunsari, who was injured during the Gen-G movement on Bhadra 23 and 24, 2082. The decision was approved by the Commission meeting.
According to the Medical Education Act, the Commission has been given the right to determine seats for admission, and there is a provision for admission on the basis of merit obtained in the Unified Entrance Examination.
The injured Shah had passed the 082/083 entrance examination with 57.5 marks and ranked 7640th. The Commission had determined the seats last November and started the student admission process. An employee of the Commission said that there was a situation where additional seats had to be added in a medical college to admit Shah. 'He will not get admission on the basis of merit.' If the government is going to order admission by specifying the names of students, why is the commission needed? What is the function of the Medical Education Act? He asked. He said that the government has interfered in the jurisdiction of the Medical Education Commission.
The decision also mentions that an additional scholarship will be provided to the injured Shah and that the Ministry of Finance will arrange the expenses for it. Medical education reform activist Dr. Govinda KC has issued a press release, saying that the decision is against the Medical Education Act and has urged the government to follow the act and establish the rule of law.
'Since there is a legal provision for admission to all disciplines including MBBS only according to the merit list and considering the perspective that students have been admitted and the teaching program has started for this year, I urge the young men and women who fight for the rule of law and Prime Minister Balen, who has the responsibility to establish it, not to break or force them to break the rule of law related to medical education. I also suggest that the young woman's aspirations be fulfilled by following the law and finding an alternative path,' Dr. KC said in a statement issued. The statement also demanded that the decision be withdrawn.
KC has urged the commission officials to pave the way if they are unable to act in accordance with the spirit and norms of the act.
Commission Vice-Chairman Dr. Anjani Kumar Jha had submitted the decision of the Council of Ministers to the full meeting of the commission after approving it from the executive committee. Commission officials refused to have a formal discussion on the decision.
