Why wasn't the former CDO of Kathmandu taken to court to extend his term?

Chhabilal Rijal, who was the Chief District Officer of Kathmandu during the Gen-G movement, was arrested by the police on Tuesday but has not been produced in court. The delay in producing him in court came after the government prosecutor's office prepared to arrest him and give a written opinion on whether to proceed with the investigation or not. After discussions with the government prosecutor, the police had also sought a written opinion. However, the opinion had not been received from the government prosecutor by 5:30 pm. Kathmandu Police Spokesperson SP Pawan Kumar Bhattarai said that Rijal is being questioned. The police had arrested Rijal to implement the recommendation of the Gauri Bahadur Karki-led commission. Rijal, however, has been saying that he was only fulfilling his responsibilities as an employee. Even after being arrested by the Valley Crime Investigation Office, he has repeated the same thing. The employees have been saying that it will be difficult to work if they are arrested while fulfilling their regular responsibilities. The commission had also recommended criminal action against security personnel. However, the Council of Ministers is preparing to form a separate study committee in their case and take its recommendation.  The police had earlier arrested former Prime Minister KP Sharma Oli and former Home Minister Ramesh Lekhak for the implementation of the report. The report had recommended action against Oli, Lekhak and Khapung under Sections 181 and 182 of the Criminal Code. 

Section 181 states that ‘no one shall kill anyone by negligent act’ and Section 182 states that ‘no one shall kill anyone by negligent act’. If the offence under Section 181 is confirmed, there is a provision for imprisonment for 3 to 10 years and a fine of 30,000 to 100,000 rupees, while Section 182 provides for imprisonment for up to two years and a fine of up to 30,000 rupees. 

In addition to Oli, Lekhak and Khapung, the commission recommended that action be taken against then Home Secretary Gokarna Mani Duwadi, Inspector General of the Armed Police Force Raju Aryal, then Chief of the National Investigation Department Hutaraj Thapa and then Chief District Officer of Kathmandu Chhabilal Rijal for the offence of negligent act leading to the death of a person under Section 182.
