Victims of the ten-year armed conflict have demanded new appointments by dismissing the two transitional justice commissions, citing previous party participation.
The demand was made by a gathering of conflict leaders from across the country in Kathmandu on the occasion of the general election held on Falgun 21, 2082, which elected a new parliament with a commitment to good governance, and the 16th International Day for the Right to Truth, 2082.
They have held in-depth discussions on the changed political situation. They say that the conflict victim community is waiting for coordination and cooperation with the government that is being formed with a large popular vote to conclude transitional justice by adopting a credible process.
Point 5.2.3 of the Comprehensive Peace Agreement signed on November 20, 2006 between the Government of Nepal and the rebel Nepal Communist Party (Maoist) promised to “make public the real names, surnames, and home addresses of those who disappeared and those who were killed during the war by both sides within 60 days of the date of the agreement and provide information to their families,” but this promise has not been fulfilled, and they have demanded that the new government work on this.
‘During the decade-long armed conflict that the country has experienced, millions of citizens have been made victims of serious human rights violations including murder, disappearance, torture, rape, property seizure, and forced displacement.’ But even as the 16th International Day for the Right to Truth is being celebrated around the world and the 20th anniversary of the peace agreement approaches, the general conflict victim community continues to struggle for the basic human right to know the truth about the atrocities of human rights violations suffered during the conflict,' the statement said. 'In the name of addressing the obligations of truth, justice and reparation, the victim community has been repeatedly ignored, and the suffering of the victims has been used for political and vested interests. Acts have been made and amended repeatedly with party consensus, and controversial appointments have been made to the commissions three times each on the basis of party shareholding. In 2082, for the third time, a party-controlled commission was formed by forcing loyal individuals who cannot question the party and leader to be recommended through a loyal recommendation committee, violating the cooperation and concerns of the victim community, clear criteria and a transparent public selection process.' The general victim community has been continuously protesting and disagreeing with the opaque process and recommendation of the recommendation committee, and the appointment of loyal characters made by showing that recommendation. A writ petition filed by 334 conflict victims from 67 districts is pending in the Supreme Court against this.
