A writ petition has been filed against the Attorney General's decision to withdraw the charge sheet filed against National Independent Party (NISP) President Rabi Lamichhane for organized crime and money laundering.
A writ petition has been filed against the Attorney General's decision to withdraw the organized crime and money laundering charges registered against Rashtriya Swayamsevak Sangh (RSS) President Ravi Lamichhane.
Attorney General Savita Bhandari had directed the District Government Attorney's Office to amend the organized crime and money laundering cases pending in various districts against more than 50 defendants, including Lamichhane. Attorney General Savita Bhandari had granted permission to the District Government Attorney's Offices to amend the charges in a 7-page 'comment and order' issued on Poush 30.
Senior advocate Dinesh Tripathi, law students Ayush Badal and Yubaraj Poudel Safal had filed a writ petition against the Attorney General's decision. The writ petition has been scheduled for hearing in a joint bench of Supreme Court Justices Nahakul Subedi and Abdul Aziz Musalman. The case has been scheduled for hearing under the 'Jha' number.
As per the permission given by Attorney General Bhandari, although the application has been filed in the Kaski and Rupandehi District Courts, it has been said that the decision will be made later, citing that the case is pending in the Supreme Court. As per the instructions of the Attorney General's Office, the Government Attorney's Offices of Kathmandu and Parsa have not filed an application with the District Court for amendment of the charge sheet including Lamichhane.
If the Supreme Court decides to dismiss the writ today, the District Court may allow the case to be withdrawn regarding the amendment of the charge sheet against Lamichhane. If the Supreme Court issues an interim order to stop it, Lamichhane's path to amendment of the charge sheet will be blocked.
