Supreme Court seeks written response on writ petition against decision to withdraw money laundering and organized crime cases involving Ravi

The Supreme Court has issued a show cause order and sought a written response from Attorney General Savita Bhandari on a writ petition filed against the decision to amend the charge sheet for money laundering and organized crime against Rashtriya Swayamsevak Sangh (RSS) President Rabi Lamichhane.

The bench of Justice Abdul Aziz Musalman made this order in a writ petition filed by Yuvraj Safal, Ayush Badal and Dinesh Tripathi.

In their writ petition, the Attorney General had sought an interim order to stop the withdrawal of cases like money laundering and organized crime, claiming that the purpose of withdrawing the case was to withdraw the case even though the charge sheet was amended. The Attorney General had decided to amend the charge sheet of all the defendants in the cooperative fraud case linked to Gorkha Media. Initially, she had made such a decision only in the case of Lamichhane, but on Friday, she revised it again and decided to approve the amendment of two charge sheets against all the defendants.

Nepal has been in a controversy after the decision to withdraw the cases of at least 50 defendants, including GB Rai, who was issued a red corner notice at a time when he was on the risk list for money laundering.

The writ petition claims that if Attorney General Bhandari keeps amending any case as he pleases, it will lead to judicial chaos and the loss of fair justice. The writ petition also claims that the Supreme Court should intervene as every government is finalizing the cases of its close associates in this manner, putting the judicial process in jeopardy.
