The next hearing of the case has been scheduled for Magh 20. The petition has been listed as unseeable and inadmissible for the fifth time since it was scheduled. Previously, the petitions dated Poush 20, Poush 13, Poush 6 and Poush 2 were also listed as unseeable and inadmissible. Locals including Bindabasini Kansakar had filed a writ petition in the Supreme Court demanding protection of their houses and properties during the road expansion.
In the case registered against the Division Road Office, Hetauda, Hetauda Sub-metropolitan City and the Ministry of Physical Infrastructure and Transport, a single bench of Justice Meghraj Pokharel had issued a 'show cause order' in the name of the defendants on November 19.
The Supreme Court had also issued a 'short-term interim order' not to proceed with the road expansion work immediately. Despite repeated requests to discuss the continuation of the same order and the interim order, it has been included in the list of 'not allowed to be seen' and 'not allowed to be seen'.
According to the plan to expand the 25-meter road of Hetauda Bazaar, houses and huts in the market area were demolished on November 20. Locals including Kansakar had approached the Supreme Court against the project. The writ petitioners in the case have been arguing that personal property should not be damaged without proper compensation and legal process.
On November 20, the Division Road Office demolished more than 500 houses and huts within the 9.5-kilometer road boundary from Ratomate to Buddha Chowk to Rapti Bridge (Mahendra Highway) and from Buddha Chowk to Chowkitol (Tribhuvan Highway) in the course of the 25-25-meter road expansion of the main market area of Hetauda. The main market of Hetauda is currently in chaos due to the demolition of houses by the Division Road Office.
The Road Division Office, Hetauda, has stated that it is unable to proceed with the road expansion and management work due to legal complications. Road Division Chief Guru Prasad Adhikari said that the office is forced to ‘stay with its hands tied’ until the Supreme Court orders it.
The Road Division, Hetauda, has started the road expansion work by removing the houses and structures built in the main market area of Hetauda for the construction of the Asian Highway since November 20, and the Road Department is currently waiting for the court order.
There is a list of 234 houses and structures to be demolished on the right side of the road and 297 on the left side within 25/25 yards from the center of the road. Of these, about 500 structures have been demolished so far.
