The Patan High Court has ordered the withdrawal of the complaint report on the petition filed by UML leader Top Bahadur Rayamajhi seeking his release from detention.

Former Deputy Prime Minister and Energy Minister Rayamajhi, who is in custody pending trial in the Bhutanese refugee case, had filed a petition in the High Court demanding that the order of the District Court, Kathmandu be quashed.

Hearing the same petition on Friday, a single bench of Patan High Court Judge Gopal Prasad Bastola ordered the withdrawal of the complaint report.

In the petition, Rayamajhi had demanded his release from detention as per Section 71 (2) of the Criminal Procedure Code of 2074 BS. The said section states, ‘If any reasonable basis is found to prove that an accused in detention is not guilty, the court may, regardless of the stage of the proceedings in the case, hear such matter and order his release from detention.’

Although Rayamajhi filed a petition in the District Court, Kathmandu on December 21, a bench of Judge Sudarshan Lamichhane had ordered that no order be issued as per the demand. Rayamajhi had reached the higher court, saying that the same ideal was violated. The higher court said in its order on Friday, 'What is the matter with this? Please submit a brief report of the grounds taken by the court while making the order dated 2072.09.14.'

Rayamajhi has been incarcerated in Kathmandu's Dillibazaar Jail for two years in the Bhutanese refugee case. Although Congress leader Balkrishna Khand, who was involved in the same case, was released, Rayamajhi is still in prison. Recently, the UML Arghakhanchi District Committee has also recommended him as a candidate for the House of Representatives elections to be held on Falgun 21.
