Supreme Court orders on NADA general assembly dispute - 'Keep status quo without holding any more events'

The Patan High Court has issued an order to maintain the status quo without taking any further action on the NADA dispute. The order was issued by a bench of High Court Justices Tanka Prasad Gurung and Tejendra Prasad Sapkota Sharma.

"Without completing any additional programs immediately, the status quo should be maintained and the file containing all the documents adopted in the process of the general assembly election that began on the said date, 2082, should be submitted as per the rules, along with the writ of incitement pending in the court after receiving a written response or after the expiry of the period," the order said.

The High Court issued such an order in a writ petition filed by Akash Golchha. 'In this regard, the fact that the unopposed election of the Central Working Committee of NADA has already been held is evident from the organization's letter dated 22 Poush 2082 and the details of the program to be held on Friday, 25 Poush, and there is no need to issue an interim order to stop the election as demanded in the supplementary petition of the petitioner,' the order states. 'Since it is also mentioned in the petition that the order to convene the general assembly of the organization dated 29 Poush 2082 should be nullified, the additional programs mentioned in that letter to be held on 25 Poush should be kept as is, without completing them immediately, in the context of a fundamental change in the situation.'

What was the NADA dispute ?

The 49th general meeting of the Automobiles Association of Nepal (NADA) was held on Poush 9. The general meeting was organized by a team led by President Karan Chaudhary, but Golchha and others boycotted it.

The team including NADA member Akash Golchha did not attend the general meeting, saying it was against the statute.

The general meeting had announced that NADA would be included in the federation and elections would be held on Poush 25. However, Surendra Kumar Upreti had already been unanimously elected as the president before that. The announcement of the new working committee was planned to be made on Friday. The District Administration Office, Kathmandu, had expressed concern that the general meeting was being held on Wednesday without the agenda of electing a new working committee, which is required every two years for NADA.

The administration had instructed not to take any action on the proposal to include NADA in the federation, saying that it was not legal. But the general meeting had decided to include NADA in the federation. Then the Golchha group approached the High Court.
