With the government's approval of the Nepal Citizenship (Fourth Amendment) Regulations, 2082 by the Council of Ministers and its publication in the Gazette, the provision of the Citizenship Act, 2063, which grants citizenship in the mother's name to those whose father's identity is unknown, will be implemented.

The Nepal Citizenship (Second Amendment) Act, 2082, which was enacted to amend the Nepal Citizenship Act, 2063 to facilitate the provision for children born to Nepali citizen mothers to obtain citizenship in the mother's name, was ratified by the President on Asoj 5. The Citizenship Regulations, 2063, have been amended for the fourth time to implement the provisions made in the said amendment act.

The document, which was approved by the Council of Ministers on Poush 11, has been published in the Nepal Gazette on Poush 21 and a circular has been issued to all 77 District Administration Offices to implement it.

What are the new provisions?

In the past, if one of the parents acquired citizenship by birth, but one of them died without acquiring citizenship or was out of contact, the child of the deceased without acquiring citizenship or was out of contact can obtain naturalized citizenship if he/she completes the process and documents as prescribed by the regulations.
Even if he/she was born abroad to a Nepali mother, but did not obtain a foreign passport or citizenship and could not reveal the identity of the father and is permanently residing in Nepal, he/she can obtain naturalized citizenship if he/she completes the process and documents as prescribed by the regulations.
According to the new arrangement, the child of one of the fathers or mothers who acquired Nepali citizenship by birth and the other died without acquiring citizenship or has no address, and the child of a Nepali mother who was born abroad and is permanently residing in Nepal without the identity of the father has been added, and the Chief District Officer can grant naturalized Nepali citizenship after conducting the necessary investigation.
In this way, in addition to the documents prescribed by the regulations, self-declaration has been taken as an important basis, and the latest amendment has also made provision for the necessary format for that.
Similarly, while previously naturalized citizenship other than naturalized by marriage was granted only by the decision of the Ministry of Home Affairs, the new legal system has made the Chief District Officer more responsible for issuing citizenship by delegating this authority to the Chief District Officer.
Similarly, the latest amendment to the regulations has also included the provision that a foreign woman who needs a visa must have her Nepali visa regularized before granting naturalized citizenship by marriage to a foreign woman who is married to a Nepali man, which was not covered by the previous legal system.
