Although the Supreme Court refused to issue an interim order on the age dispute in the appointment of the member secretary of the Pashupati Area Development Fund, it has given priority to the writ petition.
The Supreme Court issued such an order along with a show cause order on Thursday. The bench of Justice Sunil Kumar Pokharel made such an order on a writ petition filed by Bheshraj Luintel. The hearing will be held with priority as the Supreme Court has given priority.
The government had appointed Prakashmani Sharma as the member secretary of the fund. Kathmandu Metropolitan City Ward No. 18 resident Bheshraj Luintel had filed a writ petition on Wednesday, making the fund and the Ministry of Culture, Tourism and Civil Aviation the defendants.
The writ petition sought to quash the appointment of member-secretary Sharma on the grounds of his age limit. The writ petition claimed that the government had made provisions for age limits for appointments to any public post in the law and that even in the Supreme Court and constitutional commissions, there was a provision for retirement at the age of 65, but the government had appointed member-secretary of the Pashupati Area Development Fund Sharma when he had completed the age of 70. However, Sharma has been insisting that the claims made in the writ are not true.
He has been claiming that he is eligible as per the regulations of the Pashupati Development Fund. He also claims that there is no age limit for the appointment of member secretary in the Pashupati Development Fund.
