The Supreme Court has issued an order to convene a discussion on the dispute over the appointment of members and secretaries of the Pashupati Area Development Fund. A single bench of Justice Mahesh Sharma Poudel issued the order until further discussion.

The government had appointed Prakash Mani Sharma as the member-secretary of the fund.  Kathmandu Metropolitan City Ward No. 18 resident Bheshraj Luintel had filed a writ petition on Wednesday, making the fund and the Ministry of Culture, Tourism and Civil Aviation the defendants.

The Supreme Court has also issued a show cause order, seeking a written response to the writ petition seeking to cancel the appointment.

Supreme Court spokesperson Arjun Koirala said that the matter on which the short-term interim order was issued can be said after the written order is issued. . The writ petition sought to cancel the appointment of member-secretary Sharma citing the age limit.

The government had made a provision in law for the age limit for appointment to any public post and there is a provision for retirement at 65 years even in the Supreme Court and constitutional commissions, but the Pashupati Area Development Fund member-secretary Sharma had been appointed when he had completed 70 years of age.  The writ petition had argued that a person who has completed the age of 70 cannot be a member-secretary of the Pashupati Area Development Fund.
