Election Code of Conduct: Stricter measures against AI misuse and misleading posts

The 'Election Code of Conduct, 2082' approved by the Election Commission has made provision to strictly regulate the use of social media and artificial intelligence (AI) during the election period. The commission has made clear prohibitive provisions to prevent 'digital interference', stating that misuse of technology can have an undue influence on voters, parties or candidates.

The Commission has made provisions to prohibit the dissemination of false, misleading or incomplete information, posting/sharing promotional materials and influence activities through financial transactions on social media.

Similarly, it has been prohibited to create, publish or broadcast propaganda, criticism, misleading content (deepfake, fake audio/video) in favor or against any party or candidate using AI. Election-related content cannot be boosted, promoted or targeted advertisements without the permission of the Commission.

Point (l) of Chapter 2 of 'Conduct to be followed by all' states, 'No one shall post, repost, share, comment or counter-comment on social media with the intention of influencing the election, with or without the use of Artificial Intelligence (AI).'

Similarly, point (d) states that 'misleading comments such as denigration, misinformation, dissemination of misleading information, insults, hate speech, etc., with the aim of influencing the election, whether or not using artificial intelligence (AI), shall not be made or caused to be made on social media.'   

The code of conduct has given priority to the principle that the source of published or disseminated information/material should be clearly disclosed and that the use of technology should not have undue influence on voters, parties or candidates.  The Commission is of the view that technology should not be used as a propaganda tool except for the management of elections, voter education, or the official purposes of the Commission.
