Gorkha Media Vice President and former DIG Chhabilal Joshi, who was detained in the case of embezzlement of funds from Butwal's Supreme Cooperative, has been released from prison.
Joshi was released from custody after paying a bank guarantee of Rs 30 million, said Padam Aryal, Information Officer of the Rupandehi District Court.
National Independent Party President Rabi Lamichhane, who had demanded to be released from custody after paying the amount due, was released from custody on Friday by the High Court order. In Chhabilal's case, an order was issued to file a petition again in the district court saying that the petition was not completed and the amount due was deposited. Accordingly, they filed the petition on Friday and on Sunday, the bench of District Court Judge Dilli Raj Sharma ordered his release. Joshi's son Rochak Joshi, who is also a lawyer, said that he completed all the procedures and was released from custody on Sunday after the order.
Rabi Lamichhane, who was in custody for trial in the Supreme Cooperative fraud case in Butwal, had paid the amount due for his share of the misappropriation in the cooperative, but the bench of District Court Judge Narayan Sapkota of Rupandehi had refused to release him on July 26.
Ravi Lamichhane and Chhabilal Joshi had approached the High Court against this. Earlier, in Lamichhane's case, the High Court Tulsipur Butwal bench of Justice Milan Kumar Rai and Om Prasad Aryal had ordered that both cases including Chhabilal be filed together as they were of the same nature.
When Lamichhane demanded to pay the amount as per the amount and fight the case outside the jail, the High Court had ordered that the file of Chhabilal Joshi be submitted along with Ravi. Earlier, the Butwal High Court had ordered to seek a plea report in Lamichhane's case.
Despite the arson and vandalism in the Tulsipur Butwal bench of the High Court during the Gen-G protest, the case files of both Lamichhane and Joshi remained intact. Lamichhane, who is in custody for trial in the Supreme Cooperative Fraud case in Butwal, had filed a petition in the High Court on Bhadra 9 after the Rupandehi District Court did not release him even after he submitted the amount of the amount he had misappropriated in the cooperative.
A charge sheet has been filed against the defendants Ravi and Chhabilal Sahi in the Supreme Cooperative Fraud case in Butwal, fixing a collective amount of Rs 109.936 million. However, Lamichhane had submitted a document stating that he had submitted one part of the amount equal to his share out of the four parts. Lamichhane had submitted a bank guarantee of Rs 27.484 million with the application.
Like Lamichhane, Joshi had also submitted a guarantee for the same amount. However, the District Court had made a similar order that both defendants could not be released as it was not clear how much amount would be fixed for their share.
Both Lamichhane and Joshi were in jail for the trial. After the district court's order, Chhabilal has also been granted the privilege of sitting outside and hearing the case.
