Rabi Lamichhane, the president of the National Independent Party and the then managing director of Gorkha Media, is set to be released from detention on Friday. Despite the court order, Lamichhane was unable to be released on Thursday as he had to appear in person at the Rupandehi District Court to submit documents.
On Thursday, a bench of Justices Basudev Acharya and Tej Narayan Poudel of the Tulsipur High Court Butwal bench has ordered Lamichhane to be released from custody with conditions, overturning the district court's order of 26th Shrawan and taking a bank guarantee equal to the amount.
The original file of the high court's order will reach the Rupandehi District Court, Bhairahawa on Friday. After that, the district court has ordered him to be released from custody with conditions, after obtaining the guarantee of the amount as per the high court's order and if additional liability is created in the case of the amount when the court decides later, if the document is approved, he will be released from custody. Ravi Lamichhane will be present in person and submit the approved document, and then he will be released from custody with a date.
The process for that has started since Thursday and all the processes will be completed on Friday as per the court's order, said Avinash Acharya, personal secretary of Ravi Lamichhane. "We will present the chairman in court on Friday in coordination with the district court and security agencies," he said, "after which he will be released on Friday."
As per the court order, the High Court has accepted the bail of Rs 10 million that Rabi Lamichhane had previously paid. It has also accepted a bank guarantee of Rs 27.484 million in addition to that. The court has also ordered that Rabi Lamichhane be ready to pay the liabilities that arise thereafter and that if Rabi Lamichhane has to travel abroad, he must give prior information to the court, said the court's information officer Ram Bahadur Kunwar.
Rabi Lamichhane was arrested by the order of the Tulsipur High Court Butwal Bench on Chaitra 22, 2081. Arrested from Kathmandu, he was initially kept in the Bhairahawa District Jail. Lamichhane is currently in the Nakkhu Jail in Lalitpur.
The process of filing a formal application for Chhabilal Joshi, who is currently in Bhairahawa Jail, will also begin from Friday. Joshi's son Rochak Joshi said that he will file a new application and submit a bank guarantee for the amount on Friday.
