Law Minister Sinha's response to the Supreme Court - 'I took responsibility for resolving the critical situation'

Minister for Law, Justice and Parliamentary Affairs Anil Kumar Sinha has claimed that he was appointed as a minister to provide a solution to the crisis that arose due to the incidents that took place on Bhadra 23 and 24 and that is why he accepted the post.

Minister Sinha made this claim while submitting a written reply to a writ petition filed by Yubaraj Safal, claiming that a former judge cannot become a minister with the dissolution of the House of Representatives.

‘The President took steps to protect the constitution and the state system for a political exit and normalization from the crisis situation that posed a serious threat to the constitution and the state system,’ the written reply said, ‘The new government was formed by fulfilling the duties as per clause (4) of Article 61 and I was appointed as a minister accordingly. Therefore, the work related to the formation of the current Council of Ministers should be considered as a natural event created by special and unusual circumstances.’

He claimed that it should be considered as an unwritten extraordinary right of the constitution.

He has claimed in his written reply that it is true that the Council of Ministers was formed and became legitimate under the chairmanship of the then Chief Justice (from 2069.12.1 to 2070.10.28).

At that time, Khilraj Regmi, as the chairman of the Council of Ministers, had conducted the election of the second Constituent Assembly.
