The Supreme Court has issued a short-term interim order for a few days to suspend the implementation of the government's notice regarding the preparations to demolish the Hetauda market for road expansion.
In a writ petition filed by the then MP of the Rashtriya Swayamsevak Sangh (RSS), Bindabasini Kansakar, who is also a former member of the House of Representatives, a single bench of Justice Meghraj Pokharel has ordered both parties to remain in the status quo without implementing any activities or information related to the demolition for the period. The Road Division Office, Hetauda, had issued the notice giving a deadline of today.
The Supreme Court has called both parties for discussion on 26 Mangsir.
‘Until the matter is discussed by both parties and the issue of whether or not an interim order will be issued, the respondent Federal Road Supervision and Monitoring Office, Kathmandu, Road Division, Hetauda, Makawanpur, shall remain in the status quo without implementing the notice dated 2082/08/05/,’ the order states.
The 15-day ultimatum given to remove permanent and temporary houses and structures built within 25-25 yards from the center line of the road boundary of the national highway within the Hetauda sub-metropolitan area was ending on Friday. The Supreme Court has issued a short-term interim order while the Road Division has started preparations to remove houses and structures built within the road boundary from Saturday, i.e. 20 Mangsir.
With the Supreme Court's order, the road expansion work is now in limbo until the next hearing. For a long time, this dispute was settled in the Supreme Court.
The Supreme Court had already given compensation in the past and ruled that if it was due, it should be demolished after proper management.
