The case against the decision to abolish the 'Land Disputes Resolution Commission' has been scheduled to be presented before a bench of Supreme Court Justices Sharanga Subedi and Shrikant Poudel.
The case was scheduled for hearing on Sunday under case number 'C'. The office bearers of the commission, including commission chair Hari Prasad Rijal, had filed a writ petition seeking quashing of the decision to dissolve the commission, alleging that injustice had been done to landless Dalit families after the government decided to dissolve the commission.
A short-term interim order was issued on 11 Kartik after the first hearing on the petition, and an interim order was issued on 13 Kartik after arguments from both sides.
On 11 Kartik, the Supreme Court issued a short-term interim order, saying, 'The implementation of the decision of 23 Asoj by the respondent Nepal Government Council of Ministers to dissolve the Land Problem Resolution Commission and its district committees until the interim order is discussed, should be maintained in the same state as it is at present.'
On 13 Kartik, it issued an interim order, saying, 'In view of the fact that the work of the commission to be formed is also possible from other government bodies, including the Land Act,' it issued an interim order.
The ‘Land Problem Resolution Commission’, which was last formed on 13 Kartik 2081, had moved ahead with its work at a rapid pace, calling it ‘the last opportunity for land registration and land acquisition in the names of landless Dalits, landless squatters and unorganized settlers across the country’. The hearing to be held today is expected to decide whether to proceed with the commission’s work or not.
