The hearing of the case of Rastriya Swatantra Party President Ravi Lamichhane and Chhabilal Joshi, who are in custody on charges of fraud and organized crime at the Supreme Cooperative Society of Butwal, has been scheduled for today. Earlier, in the hearing held on Kartik 10, the Supreme Court had ordered to seek the original file of the main charge.
Last Thursday, the bench of Justices Basudev Acharya and Om Prasad Aryal of the Tulsipur High Court, Butwal Bench, had ordered the original charge sheet to be filed. The court's information officer Ram Bahadur Kunwar informed that the hearing was scheduled for Thursday after the original case file was received.
Earlier, on Kartik 20, the Acharya-Aryal bench had ordered the original file to be filed. Although the original file was not received from the Supreme Court, the hearing was held on Thursday after a copy was received from the district court. The court is proceeding with Lamichhane's case on priority.
The hearing was also scheduled for Kartik 3, but the hearing was postponed after Chhabilal Joshi's legal practitioner filed a petition. Earlier, the bench of Justices Milan Kumar Rai and Om Prasad Aryal had ordered that the cases of both the defendants be kept together since they are of the same nature.
Lamichhane had filed a petition demanding that he be allowed to fight the case outside the jail by paying the amount as per the amount. The High Court had ordered Joshi's file to be submitted along with Ravi. Earlier, the High Court, Butwal, had ordered a request for a plea report in Lamichhane's case.
Despite the arson and vandalism at the Tulsipur High Court, Butwal bench during the Gen-G protest, the files of both Lamichhane and Joshi have survived. Lamichhane, who is in custody awaiting trial in the Supreme Cooperative Fraud case, had filed a petition in the High Court on Bhadra 9 after the Rupandehi District Court did not release him despite having paid his share of compensation for the mismanagement in the cooperative.
He had earlier filed a petition in the District Court and sought to be released from the cooperative fraud case. The bench of District Court Judge Narayan Sapkota had rejected his petition on July 26.
A charge sheet has been filed against Ravi and the defendants in the Supreme Cooperative Fraud case, fixing a collective compensation of Rs 109.936 crore. Lamichhane had submitted a bank guarantee of Rs 27.484 crore, equivalent to his share out of the four parts.
Like Lamichhane, Joshi had also submitted a bail of the same amount. However, since it was not clear how much the personal expenses of both the defendants would be, the decision to not release them was issued equally in their case.
Both are currently in custody pending trial. Lamichhane, who is in Bhairahawa Prison, has been transferred to Nakhkhu Prison in Lalitpur, while Joshi is in Bhairahawa.
