The case of manslaughter, which has been pending since 2078 BS, has been scheduled for hearing in the bench of Justices Sunil Kumar Pokharel and Nripadhwaj Niraula. This dispute has been entangled in the Supreme Court for four years.
The case, which reached the Supreme Court on 27th Shrawan 2078, has not been heard for a long time. On 29th Chaitra 2077, the Hetauda bench of the Patan High Court upheld the Chitwan District Court's decision to acquit all those accused of killing Adhikari.
The first hearing was held on 12th Baisakh 2081 and an order was made to give notice of the hearing to all the defendants, including the government. Justices Kumar Chudal and Til Prasad Shrestha made this order. All subsequent hearings have been postponed and the hearing has been postponed.
Krishna Prasad of Gorkha was murdered in 2061 BS in Chitwan. Cases are being filed in one court after another on the charge of kidnapping and murder by cadres of the then conflicting party, the CPN-Maoist. Gangamaya and Nanda Prasad Adhikari had filed a complaint alleging that 12 people, including Sita Adhikari and Chhabilal Poudel, residents of Gorkha Phujel, were involved in the murder of their son Krishna Prasad.
Based on the same complaint, the District Court, Chitwan, had acquitted all the defendants in the case filed by the police in 2075 BS. A bench of Justices Chandiraj Dhakal and Marina Shrestha of the Hetauda bench of the Patan High Court had upheld the decision of the Chitwan District Court.
The Chitwan District Court had decided to acquit the defendants, saying there was insufficient evidence to prove that Adhikari had been murdered. The government has appealed against this all the way to the Supreme Court.
Nanda Prasad died while on hunger strike, while Gangamaya is still under government protection. The defendants in the incident, Sita Adhikari, Chhabilal Poudel, Ram Prasad Adhikari, Parashuram Poudel alias Ajiv, Him Lal Adhikari, Meghnath Poudel, Bishnu Tiwari, Kali Prasad Adhikari, Bhishma Raj Poudel alias Bhimsen, Ram Prasad Adhikari, Januka Poudel and Subhadra Tiwari, all residents of Gorkha Phujel, were acquitted.
Krishna Prasad was abducted and murdered on 24 Jestha 2061. He was abducted and murdered in Bakulhar, Ratnanagar, when he had come to visit his maternal grandfather in Jayamangla, East Chitwan after taking the entrance exam. Gangamaya and Nanda Prasad had been on a hunger strike for a long time to file a complaint after the murder of their son.
A case was filed against 13 people in the Chitwan District Court on 30 Chaitra 2070. The case in his name was postponed as one of them was absconding. Nanda Prasad's body is still at the Maharajgunj Teaching Hospital after Gangamaya said she would not cremate her husband until her son's perpetrators were brought to justice.
