The Nepal Bar Association has criticized the government for not implementing the court's interim order against the government's decision to recall the ambassador.
The Bar's statement states that any act of directly or indirectly deriving a result different from the court's order, based on the constitutional provisions, the concept of constitutionalism, an independent judiciary, and Article 128 (4) of the Constitution that the country has accepted, is not only disobedience to the court's order but also an act that weakens the rule of law.
'Even if a healthy, academic discussion can be held on the court's decision or order, it is everyone's duty to directly or indirectly comply with the decision or order,' the Bar said. The Bar has said that not complying with the court's decision or order indirectly promotes arbitrariness. The Bar has requested that the court's order or decision be followed literally and not to do anything that would undermine faith in the court.
In the context of the recent decision of the Government of Nepal to recall ambassadors, while the case is pending in the Supreme Court and an interim order is being issued, the concerned ambassadors have been asked not to violate the court order, stating that the government has drawn serious attention to the fact that they were recalled to work at the Ministry of Foreign Affairs.
