The investigation commission has sent the complaint against the former Prime Minister KP Sharma Oli and the former Home Minister Ramesh Akhtar back to the police. The Commission issued a statement on Thursday and said that the application and documents were sent back to the District Police Complex, Kathmandu.
Kathmandu police did not register a complaint saying that the commission led by former judge Gauri Bahadur Karki was working. The complaint was sent directly to the commission.
Vigyanraj Sharma, a member of the commission, said that the complaint was sent back because it was not within the jurisdiction of the commission to prosecute in cases where the criminal charges were investigated in detail.
"It is known that the Nepalese law has given authority to make anyone involved in criminal offenses be immediately investigated and prosecuted by the mechanisms of the government of Nepal," he said, "There is no need to wait for the report of this commission to investigate criminal cases, and the complaint and documents received with a copy of the press release of the commission dated 2082/06/21 will be sent back to the district police complex, Kathmandu."
In the said commission's statement, it was said that those involved in criminal offenses should not wait for the commission's report to be investigated and prosecuted by government mechanisms. It was said that the Commission has a mandate to receive and analyze information or petitions related to physical and human damage and to give necessary opinions regarding action. Three days ago, Sudhan Gurung reached District Police Complex, Kathmandu with a complaint against Oli and the writer. However, the police refused to file a complaint.
Instead, there was a discussion about how to proceed with the complaint in Baluwatar and Singhdarbar. In the discussion held in Baluwatar, the heads of the security agencies suggested the government to exercise restraint. Later, making Balen Shah and Gurung as opponents, UMA also filed a counter complaint with the police.
UML President Oli also said that there was a discussion all night about how to arrest him on Thursday. And, they claimed that the current situation is nothing new, saying that they have already been jailed. He also claimed that the country and sovereignty are being attacked.
