The Nepal Bar Association has protested that the attempt to run a directed court has started by keeping the independent judiciary in fear and terror. General Secretary of the Bar Kedar Koirala issued a statement and claimed that the reform of the Judiciary should not depend on the reports of the Judiciary but on the instructions from the street.
The 16th National Conference of the Nepal Bar Association stated that its opinion on the restructuring of the judiciary was clear. It is said that the reform of the judiciary should be done in broad consultation through the statutory mechanism.
The Association strongly condemns Kuchesta, who is running the court directed by putting the independent judiciary in fear and terror through the media. Independent, competent and accountable judiciary is the recognition of the association. The association strongly opposes any forceful oppression, forced attacks and illegal activities,'' the statement of the bar said, 'no matter how difficult the country is, the basic standards of the rule of law cannot be ignored. We would like to remind that it is the first responsibility of the state to follow the basic standards of human rights including fair hearing.'
The government should be serious about the actions taken by the security agencies, especially the Nepal Police, to demoralize. Bar also says that passion, anger and anarchy lead to a vicious circle of murder, violence and counter-violence.
The bar has demanded that all the courts, including the Supreme Court, start regular proceedings immediately. Barley The previous opinion of the chairman of the commission formed to investigate the incident of Zen-ji on August 23rd and the incidents of vandalism, arson and looting on August 24th said that there was no credible assurance that the impartiality of the commission would not be compromised.
'In order to investigate such a serious incident, the general opinion is that the government of Nepal has taken the subject of investigation lightly to fulfill only the formalities. Because of this, even the commission's report will lose credibility,' said Bar .
