Chief Justice Prakashmansingh Raut has dragged Baraka District Judge Bhola Dhakal to the Judicial Council. Judge Dhakal was summoned to the council for investigation after a complaint was received that he had given an order in the case of asset laundering.
As soon as the court opened on Tuesday, Chief Justice Raut pulled Dhakal to the council for investigation to stop him from working at the bar, council sources said.
Earlier, the Bara District Court Bar Association had decided to boycott Dhakal's bench expressing serious disagreement with his order.
What was the dispute?
Bhola Dhakal, Chief Judge of Bara District Court, came into controversy after ordering the release of a fugitive on bail when there was no regular hearing in the court after the Gen-G movement.
Indian citizen Ashok Kumar Sinha and his daughter Nivedika Sinha, who is also a citizen of Nepal, who are absconding in the case of wealth laundering, were ordered to be released from prison after demanding bail.
But it is alleged that the people who were presented in the court were not Ashok Kumar Sinha and Nivedika Sinha, but dummy persons were set up and they were released on bail only by looking at their Aadhaar cards . It was also alleged that the defendants were ordered to release them on bail by taking a large sum of money.
There is a provision in the law that foreign nationals who can be sentenced to imprisonment for more than one year should be kept in custody and the case should be tried.
Bar through its statement said that due to Judge Dhakal's order against the law, there has been a serious crisis in the faith towards the court itself, so it will boycott his bench.
