Judicial Service Commission has opened advertisement for 21 District Judge vacancies. The notice was issued at the 31st August meeting of the Commission.  The meeting of the Judicial Service Commission presided over by Chief Justice Prakashmansingh Raut has advertised for the appointment of judges based on the percentage prescribed by the constitution.

The commission has announced the quota of 11 internal open, 6 open, women 1, tribal/tribal 2 and Madhesi 1. It is mentioned in the notification of the commission that the application can be filed within 30 days of the advertisement. A separate application fee of 2000 rupees for internal open and 2000 rupees for open and 500 rupees for additional inclusion will be charged separately. 

Article 149 of the Constitution has provision regarding the appointment of District Judge.  In clause 1 of the said article, the appointment of the judge of the district court shall be made by the Chief Justice on the recommendation of the Council of Justice  It has been said. Clause  It is mentioned in (2) that twenty percent of the vacant district court posts will be filled from among the officers who have obtained a bachelor's degree in law and have worked for at least three years in the gazetted second-class post of the judicial service based on the evaluation of seniority, competence and efficiency.   In clause (b)  It is said that forty percent of the vacant posts will be filled on the basis of an open competitive examination from among the officers who have obtained a bachelor's degree in law and have worked at least three years in the gazetted second category of the judicial service.  For the remaining 40 percent of vacant positions, Nepalis who have obtained a bachelor's degree in law and advocated continuously for at least eight years as an advocate, obtained a bachelor's degree in law and worked for at least eight years in a gazetted position of the justice service, or have worked for at least eight years continuously in law teaching, research or any other field related to law or justice  It is said that the appointment will be made on the basis of open competitive examination from among the citizens. 

In clause (3)  According to the federal law, the Judicial Service Commission will take a written and oral competitive examination and recommend to the Council of Justice for appointment as a district judge according to the order of merit from among the persons who have the qualifications as per clause (b) and (c) of sub-section (2). 

According to this provision of the constitution, the Commission has issued a notice for the new examination. In the past, only a small number of passers and those who failed in the exam have been recommended to become judges. But this time the passing percentage has been reduced. 

Section 13 of the Judicial Service Commission Act 2073 was amended to bring at least 50 percent to 40 percent.
