The Legislation Management Committee of the National Assembly has agreed to keep a two-year 'cooling off period' in the Federal Civil Service Bill. The meeting of the committee on Saturday arranged for a 'cooling off period' of two years for the civil servants.
The 'cooling off period' arrangement was circumvented in the House of Representatives. The decision made by the Parliament was manipulated by putting a provision to break the system unanimously put by the Public Order and Good Governance Committee.
In the meeting of the Legislative Management Committee on Saturday, it was agreed to keep the 'cooling off period' for two years . In the committee, Federal Affairs and General Administration Minister Bhagwati Neupane said that the government agreed to keep the 'cooling off period' according to the issues raised by the parliamentarians. The parliamentarians said that the provision of 'cooling off period' should be applied to the chief secretary, secretary and joint secretaries rather than to the lower level employees . Accepting the matter, Minister Neupane said, 'Keeping this arrangement should not cause inconvenience to the employees below. It has been established that the cooling off period should be kept in the Civil Bill itself. Because of that, it is necessary to come to a conclusion with positive thinking in the same way. Let's go to what many honorable people think about the cooling off period.'
MPs from Congress, Maoists, United Socialists, Jaspa Nepal and others were of the opinion that a two-year 'cooling off period' should be kept. UML had proposed that 'cooling off period' should be kept but it can be less than two years . When it was agreed to keep this arrangement, the MPs of UML expressed their silent support without expressing their opinions.
The chairman of the committee Tulsa Dahal instructed the committee secretariat to write a report by adjusting the arrangements in the committee linguistically.
During the passage of the Civil Bill by the State Order Committee under the House of Representatives, the system of 'cooling off period' was tampered with. The committee unanimously passed the report in section 82 (4) with the provision that "Civil servants or employees who have resigned or retired from the service will not be appointed to any constitutional or government post before the completion of two years from the date of retirement".
After the provision of 'cooling off period' was put in place by the committee, the provision that was already placed in the bill that 'not to be appointed to a position other than constitutional or diplomatic appointment and any other appointment made by the Government of Nepal' had to be removed. But after it was retained in section 82 (5A), questions were raised everywhere after the provisions passed by the committee were broken.
A special committee was formed to investigate the case. The committee also suggested that the provision of 'cooling off period' should be removed from the National Assembly. Considering the suggestions of the investigation committee, the parliamentary committee under the National Assembly has decided to keep the 'cooling off period' for two years.
This bill was passed by the House of Representatives and came to the National Assembly. This bill should be passed by the National Assembly and returned to the House of Representatives within 17th of Bhadra. After the National Assembly sends back the Bill, the Speaker will have to verify it and send it to the President for verification. Then this Act will come into effect .
After the implementation of this bill, a 'cooling off period' will be applied for civil servants or government employees who will not be able to take appointments in non-governmental organizations for two years after their compulsory retirement or resignation due to conflicts of constitutional, diplomatic and governmental interests. In this bill, the retirement age of employees has been increased from 58 to 60 years.
