The joint bench of Justices Kumar Regmi and Sunil Kumar Pokharel has issued this order in the name of the government. A writ was filed with the claim that construction of haphazard structures was started at the birthplace of Buddha and such a decision would affect the site of archaeological importance, which is also on the World Heritage List . Delivering the final verdict on the writ, the Supreme Court has decided that even in the case of industries that have been registered within 15 km of Lumbini Development Fund but have not started operating, such industries should be within the prescribed environmental pollution standards and conditions, and the industries that do not comply with the prescribed standards and conditions must be arranged before the operation of the industry, and the industries that do not comply with the prescribed standards and conditions will be relocated elsewhere within the given time period .

Industrial Promotion Board on 12th November 2066 for the protection and development of Lumbini area, all actions and correspondences and decisions taken by the Department of Industry or Government of Nepal, State Government or local government or its subordinate bodies to establish industry, it is mentioned in the order that all the actions and correspondence and decisions will be canceled by sending the order.

This order has been issued by the Supreme Court saying that the issue of Lumbini's protection is a matter of public concern and concern of all Nepalis and world humanity.

This is the four-point order

(a) South of the boundary built for the protection of Lumbini area up to the Indian border and within 15 km from the east-west and north wall and 800 m on the right and left of the road in the Lumbini Bhairawa corridor section. Do not allow any new industry to set up dust, smoke and carbon emissions inside.

b) The decision of the 190th meeting of 2066.08.12 of the Nepal Industrial Promotion Board to decide not to allow the registration of new carbon emitting industries within 15 km of the wall built for the protection of the Lumbini area means that the area up to 15 km from the wall is in accordance with the goal of creating an industry free zone that emits dust, smoke and carbon pollution. In that decision, it is mentioned that in the case of industries that were registered and operating before 2066.08.12, the relocation of industries will be given first priority, and maintaining the policy of not granting permission for capital increase, capacity increase, purpose increase and electricity capacity addition of the industries operating in this way means that at least the goal is to close such industries and relocate them. From the date of receipt of this order, within 2 years from the date of receipt of this order, industries and factories that emit dust, smoke or carbon pollution within a distance of 15 km to the east, west, north of Lumbini and up to the Indian border in the south should be closed or transferred/caused to be closed or relocated and thus, due attention should also be paid to the long-term protection of the larger Lumbini area while the industries and factories that emit dust, smoke or carbon pollution are closed or relocated.

c) To provide the necessary concession facilities if they want to operate tourism-friendly business on the empty land after the relocation of the mentioned industries .

(d) To stop the movement of public vehicles with a load capacity of more than 19 tons on the road on the south side of the wall built for the protection of the Lumbini area up to the Indian border and within 15 km from the wall in the east-west and north direction as well as on the right and left side of the road in the Lumbini Bhairahawa corridor section within 800 m.
