Complaints against four judges, law minister stalled in Justice Council investigation

The Judicial Council has initiated an inquiry against two judges each of the High Court and the District Court. The council is investigating Judges Khushi Prasad Tharu and Arjun Maharjan of Janakpur High Court Birganj who acquitted Congress leader Mohammad Aftab Amal in the murder case. District Court Rasuwa Judge Bhuwansingh Thapa and Darchula Judge Pushparaj Pandey were brought under investigation due to complaints of bad conduct.

Ex-minister Mohammad Aftab Alam, who was found guilty by the Rautahat district court of the crime of burning the injured in the bomb blast incident 17 and a half years ago, was acquitted by High Court judges Tharu and Maharjan on 14th June. During the acquittal, it was argued that no evidence was found to confirm the incident. Alam was released after the High Court verdict.

Narayan Singh Rajput, the 84-year-old father of Trilok Pratap Singh Rajput, known as Pintu, who was burnt to death in a brick kiln, went to the judicial council on 19th June and filed a complaint demanding an investigation against the judges who acquitted him. Two days after the verdict, advocate Yuvraj Safal also filed a complaint against the judges in the council. An eyewitness of the incident held a press conference on this issue.

After the pressure increased, the Justice Council assigned Justice Vinod Sharma of the Supreme Court to investigate the judges. Tharu and Maharjan have been brought before the Justice Council and the investigation has been started.

According to a member of the Justice Council, the inquiry committee has taken the judgments of the district and higher courts, the complaints registered in the Justice Council and the statements of the judges involved in the judgments, the victims and the employees of the District Public Prosecutor's Office. "It is known that the committee has completed its study and now only report writing is left," said the member, "There is a possibility that the committee will also raise some questions on Law Minister Ajay Kumar Chaurasia." Alam appealed against the decision in the High Court. He was acquitted in that appeal.

Law Minister's complaint stalled

Law Minister Ajay Kumar Chaurasia was also complained about the acquittal of Alam, demanding an investigation. He is accused of arranging the 'setting' for the verdict. Independent Member of Parliament Amresh Singh demanded an investigation in the House of Representatives by asking for the 'call details' of Minister Chaurasia. The council has not proceeded with the investigation on the complaint against the minister.

Two district judges pulled due to bad conduct 

Judge Thapa of Rasuwa said that after it was found that he had sent a message of 'sexual proposal' to the female service recipient, the Judicial Council had pulled Kathmandu for investigation . There was a complaint in the council that Thapa approached a woman who was facing a case of polygamy through a government lawyer and made a 'sexual proposal'.

District Judge Pandey of Darchula was pulled up for investigation after 13 employees of the District Court sent a mass resignation notice to the Supreme Court with a complaint. Employees have raised questions about his conduct .

Govindram Lohar and Maheshram Lohar of Malikarjun Rural Municipality-5, Darchula have filed separate complaints to Judge Pandey demanding action. They allege that Pandey acquitted the accused of murdering Gangaram Lohar, ward secretary of Malikarjun-5, on the basis of financial transactions. Pandey's bench acquitted all the defendants on 22 December 2081.
