On Sunday, the Supreme Court published the full text of this dispute and published the full text of the decision against CPN-UML leader Aryal.
In the House of Representatives election held in November 2079, Congress candidate Gurung claimed that even the votes of people who had died and those who were abroad should be invalidated as 98 percent of the votes had been cast.
Provincial Assembly candidate Syangja Chapakot's Budhishan Shrestha demanded that the election results should be annulled and re-election should be held.
But the Supreme Court has ruled that the writ will be dismissed saying that the case was filed by a person from an area without rights instead of Aryal. A constitutional bench of Chief Justice Vishwambhar Prasad Shrestha along with judges Prakashman Singh Raut, Sapna Pradhan Malla, Prakash Kumar Dhungana and Kumar Regmi dismissed the writ petition against Dhanraj a year ago on 5 August 2081. It is mentioned in the full text of the judgment that the liberal approach of being able to challenge other than competitors in matters like elections leads to unnecessary and duplicate cases in the court. The constitutional bench has said, 'Since Padma Aryal, who is in the competition, has not challenged, there is no need to enter it further.' His competitors Aryal and others filed a complaint in the Election Commission but did not file a case in the Constitutional Court.
Aryal supporters alleged that more than half a dozen polling stations in Chapakot municipality of Syangja were voted in the names of those who had died, gone abroad and were absent. In some polling stations there was up to 98 percent voting.
However, the Election Commission decided to proceed with the counting of votes, saying that there was no report of disturbance from the security agencies, but the investigation team did not see the situation.
In that election, Congress candidate Dhanraj got 31 thousand 466 votes, while Aryal got 25 thousand 839 votes in his competing position. There was a difference of 5,627 votes between them. Tikaraj Gurung of RSVP who was in the third place got 8 thousand 113 votes.
