On Thursday, a dozen senior advocates arrived with preparation to argue in the Supreme Court's bench number 6. In the full bench of Judges Nahkul Subedi, Tek Prasad Dhungana and Srikant Poudel, well-known senior advocates for both the side and the opposition wrote their names for the debate. On behalf of the government, a team led by the Deputy Attorney General was ready for the debate.

11 cases were assigned in that court. In this way, the senior advocates who came for the debate came for the debate on the dispute regarding the legitimacy of Non-Resident Nepalis (NRNAs). Information officer of the Supreme Court, Nirajan Pandey, informed that the hearing of this dispute has been postponed to Thursday next week as it could not be seen on Thursday. Mahesh Shrestha (Chairman of Shesh Ghale), who is a party to the case, commented that he was confused because of the series of adjournments instead of hearing in the court.

NRNA representatives from different countries are waiting for the decision of the court and they are disappointed because they cannot be seen in the court and are not heard. We hope and believe that NRN's campaign will proceed clearly based on the decision of the court. But there has been confusion due to the delay," Shrestha said. "We request the court to find a proper solution to the process that cannot be seen and give quick justice."

The president of the other side of NRNA, Badri KC, said that he was confused when the case was not being watched and that he had filed a petition in the Supreme Court. He expressed the hope that it will be resolved in the next session as he requested that the non-resident Nepalis not only in Nepal, but all over the world, be able to separate the judges who cannot be seen because they are waiting for this verdict .

"In the past, the case was entangled in the court for a long time as it could not be seen and was not afraid to be seen," KC said, "This time also there has been a similar problem . We have received a notification that the full court will resolve it by making a policy decision.

KC said that instead of getting stuck in the court for a long time, if there is a decision, NRNA will hold the right rhythm and request for speedy justice. Both sides of NRNA are waiting for the decision of this issue. Sources of the Supreme Court have informed that both parties have applied for the formation of a bench of judges who cannot be seen in the court because the delay in the case has affected the activities of NRNA.

According to the case division of the Supreme Court, the application will be submitted to the full court (a full meeting of judges) and a decision will be made in a few days. Currently, the KC side is sitting in the office of Baluwatar, while the Shrestha side is running the secretariat from outside waiting for the verdict. If the Supreme Court pronounces a verdict, only one side will be recognized and the NRNA will move towards dispute resolution .

The case from the highest to the highest level

The Non-Resident Nepali Association, which started with the idea of bringing investment into Nepal, was without controversy when it reached the ninth session. Sesha Ghale served as president for two terms from 2069 to 2073. Kumar Pant was elected as the President on 1 October 2076 after the dissolution. Kula Acharya was defeated by him . The dispute seems to have started from this convention. After the tenth congress could not be held in time, the practice of running the court started . As Pant's tenure has ended, there was a dispute about whether the selection of representatives to participate in the convention will be done by the new working committee of the National Coordination Council (NCC) or by the old one.

One side claimed that since Pant's tenure was over, it would be illegal for him to choose a representative with the ICC, while Pant's side claimed that it was legal until the next one came. Out of 3600 representatives, there was a big controversy in the selection of about 350 representatives. Time and again, the date of the convention was fixed but the new leadership could not be selected . Thus, when there was a dispute between the two parties, the Ministry of Foreign Affairs was also added.

Foreign Affairs wrote letters on 11th October and 17th November 2078 and sent a letter to the Union saying that the term of the Pant-led committee has ended and to go the legal way. Sending a letter to NRNA again on 3 November, he wrote that since the term of the working committee led by Pant has been completed on 18 October 2021, it has been assigned to the Guardian Council according to Article 16 of the Constitution to resolve the disputes of the union and provide mobility to the union.

After the government started the process of new elections, the pant party reached the court. This was the first case . Criticism of the officials of the Panth leadership started by saying that the NRNA had appealed to the court against the government. A meeting was held under the chairmanship of Pant on 1st January 2078 regarding another party's dispute against Pant's decision. The meeting formed a 7-member high-level committee consisting of Upendra Mahato, Jiva Lamichhane, Devman Hirachan, Bhavan Bhatt, Ram Pratap Thapa and Kumar Pant under the chairmanship of the then guardian Shesh Ghale . Four days later, on 4th January 2078, a writ was filed on behalf of the government in Patan High Court. Acting Secretary Seva Lamsal filed the case on behalf of the Ministry of Foreign Affairs.

Since there was no consensus among the members of the high-level committee, there was more controversy than unity. Both Sarkar and Pant came face to face in the High Court. While the case was pending in the court, the group opposing Pant was also added to the case. On 2 Chait 2078, Chintamani Sapkota and Umesh Kumar Pudasaini filed a new writ. On 11th March, the bench of Judges Subas Paudel and Neelam Paudel decided not to issue the interim order. Amidst the controversy, on 11th and 12th Chait, the Pant group held its 10th convention and elected three presidents. It was said that the president would take turns to amend the constitution to settle the dispute. Initially, it was agreed that Kul Acharya and Badri KC and Raveena Thapa would be presidents.

Going one step ahead of the convention held by the Pant group, the Ghale group declared Vinod Kunwar as the president by conducting a parallel tenth convention on 9th Chait. Two days later, the Pant group held a convention of the NRNA. The Congress of Pant was inaugurated by the then Prime Minister Sher Bahadur Deuba and the then President Bidya Devi Bhandari. The then Finance Minister Janardan Sharma attended the inauguration of Ghale Group. Thus, after the two parties announced their own presidents, the legality dispute reached the Patan High Court again. This was the fourth case that reached Patan High Court.

Two cases pending in the High Court were sent to Tameli after the election. The cases went to Tameli on 18th June and 29th June saying that there was no justification as the election process was over. But the issue regarding the legality of both parties was still under consideration. Later, the Supreme Court dismissed it saying that it had run out of justification . The Ministry of External Affairs authorized the NRN led by Acharya, KC and Thapa. Since the Ministry of Foreign Affairs is the line ministry of NRN, the justification of the writ was over.

This dispute reached the Supreme Court after the party did not remain silent. Janaki Gurung filed a writ in the Supreme Court on 8th November 2079, claiming that she was elected as the Secretary General from the Kunwar faction. On 12 Chait 2079, Judge Kumar  Regmi's bench issued a show cause order, not an interim order . After the Supreme Court did not issue an interim order, the elections scheduled under the chairmanship of Pant were completed . On 21 Chait 2080, the bench of two judges, Sapna Pradhan Malla and Nahkul Subedi, pronounced the verdict. While the writ filed by Janaki Gurung was pending, Rajesh Shamsher Rana filed another writ on 25 June 2080 on behalf of NRNA. Considering the said writ along with Gurung's application, the Supreme Court ordered the cancellation of the first writ and the issuance of the second writ .

The Supreme Court ruled that the decision of the people who were elected after the Panth will be invalidated by the order of sending. Soon after, directives were issued on eight points . The high-level committee established by the 81st meeting held on January 1, 2078 will be maintained and  The former presidents of the said committee were Sesha Ghale, Upendra Mahato, Jeeva Lamichhane, Devman Hirachan, Bhavan Bhatt, Ram Pratap Thapa and Kumar Prasad Pant. Vinod Kunwar, Umesh Kumar Pudasaini, Janaki Gurung, Kul Acharya, Badri KC and Ravina Thapa were asked to add 6 more people. When the Supreme Court delivered this verdict, another division had already occurred within the NRNA . Even when it came to the 11th Congress, there was no unity between the Ghale Paksha and the Establishment Paksha (Acharya, KC and Thapa). On the contrary, from the 11th Congress, there was a division between the founding parties. There was a three-way competition between Badri KC, Rajendra Kumar (RK) Sharma and Mahesh Shrestha. For the first time there was no direct voting . Online voting is done

Sharma and Shrestha, the contestants of the chairmanship, refused saying that the online voting was rigged, and one party announced that Badri KC was elected. On 28 March 2080, the Ministry of Foreign Affairs banned the Badri KC group from sitting and working in the office of NRN. The Ministry of Foreign Affairs said that the unity convention of the Supreme Court should be held on 21 March 2080  Due to the issuance of the mandate, the high-level committee holds a unity convention and does not do any activities until a new international coordination council is formed. The Supreme Court ruled on 22 July 2081 that the foreigner's letter should not be enforced and the writ was dismissed.

This verdict caused more confusion in NRN.  Controversy over which party got the recognition after the Supreme Court, which ordered the formation of a high-level committee and a unity convention, annulled the letter of the foreign ministry banning the KC group from working  Done . KC group claimed that they got legitimacy as NRNA president, while the other group said that the unity convention should be held at the time specified by the Supreme Court. According to the first decision of the Supreme Court, the rest of the Ghale group started preparing for the unity convention. Ghale also requested the KC group to sit in the high-level committee along with the former chairman for the unity convention. But the KC party focused on shifting rather than conducting elections and started running the central office of NRN by itself. The Supreme Court's judgment implementation directorate has asked the high-level committee to  Letter was sent to KC four times asking to transfer the office, but KC group did not transfer .

Despite not getting an office, Ghale opened a separate temporary office as the Supreme Court gave him the responsibility to hold a unity convention.  On 17 March 2081, Ghale issued a statement and claimed that everyone should participate in the unity convention and that the working committee elected from the 11th convention was illegal. He  3 to 5 May 2025  (20-21 Baisakh 2082) announced that elections will be held.  On 12 Baisakh 2082, the KC side filed a writ seeking to stop the entire election process . In the said writ, the Supreme  Interim order issued  Didn't . Until the last day of the convention on what will happen from the Supreme, the group is in confusion  was sitting .
