National Independent Party MP Sobita Gautam is of the opinion that there should be a legal provision that lawyers who argue cases on behalf of those who do not have money will be paid only if they win.

MP Gautam said this at the meeting of the Law, Justice and Human Rights Committee of the House of Representatives on Monday on the Nepal Legal Practitioners Council (Second Amendment) Bill.

Stating that many citizens do not get justice due to lack of finances, MP Gautam has said that there should be a legal system in which legal practitioners get remuneration if they win the cases of people with weak economic conditions.

'For those who have been wronged, who cannot find a lawyer, for those who cannot find a lawyer to fight their case, we can set a condition for them to be paid if they win the case on behalf of the person who has been wronged but does not have the money to fight the case,' MP Gautam proposed, 'It would be easier if the place to make a condition is put in the law. If someone fights the case unpaid, that arrangement can also be made.'

Stating that the provision of remuneration for helpless citizens should be included in the bill only after winning the case, MP Gautam said, "Many people are suffering because they cannot find lawyers to fight their cases." Lawyers clarify the subject of their remuneration in advance. When there is a situation where the salary is not coming, even the legal professionals behave as if they do not fight such a case,' she said, 'people who have been wronged do not have a position with legal professionals . It is not appropriate that the remuneration of legal practitioners is determined based on the winning and losing of the case.'

MP Gautam said that legal reform is necessary to ensure equal access to justice.
