Home Minister Ramesh Akhtar has said that there is a legal arrangement to grant citizenship in the name of the mother for the children of fatherless children. In the meeting of the National Assembly on Friday, the Minister of Home Affairs said that there was a problem in the distribution of citizenship and that a legal arrangement had been made to solve it.
The Home Minister said that the issue of citizenship is going to be solved by giving citizenship in the name of the mother to the children who are not protected by their father.
He said that they are going to amend the Citizenship Act to provide citizenship in the name of the mother. "This provision has been made for children of fathers who are not helping to give citizenship, fathers who are physically fathers but are not ready to give affection, protection and guardianship to their children and children have not been able to feel that they are their fathers, or children who have suffered from fathers," he said.
Home Minister Akbar mentioned that the lack of nationality and citizenship is a very painful situation and informed that the government has included various proposals in the bill to address it. He said that according to the current system, only if both father and mother are Nepali citizens, the child will get the citizenship of the descendant and if the mother is a foreigner, the child will be given naturalized citizenship.
The Home Minister author also said that the bill was moved forward cautiously as amending the Citizenship Act without changing the provisions of the Constitution would lead to legal complications. "A provision can be made to give citizenship to the descendants from the mother's name, but for that, it may be necessary to look at the constitution." Now, if both the mother and the father are citizens of Nepal, the descendants will be born. If we make a law to change the provisions of the constitution because of the provision that if the mother is not a Nepali, then the law cannot be implemented," he said.
The home minister also requested that the bill be passed by the assembly soon.
