Kathmandu District Court has rejected the injunction petition filed by Nepal Securities Board Chairman Santosh Narayan Shrestha against Nepalkhabar.com and Wizmandu.com. The bench of Judge Shyamvihari Maurya rejected the application for injunction.
Deepak Kumar Shrestha, Information Officer of Kathmandu District Court, said that the application for injunction has been dismissed. Along with this, the order to remove the news issued by another judge Pitambar Sharma's bench on June 27 has also been cancelled.
Earlier, Judge Sharma had issued an interim order to 'immediately remove' the news published on Nepalkhabar.com and Bizmandu.com about Shrestha, chairman of the Securities Board, and not to write news about Shrestha in the future.
Kathmandu District Court's order to remove the news online was a violation of the right to communication under the preamble of the Constitution of Nepal and the Nepal Journalist Federation and other organizations protested.
Bizmandu.com and Nepal Khabar said that they will not remove the news. Bizmandu wrote through an editorial note last Wednesday that he did not understand the order issued by the court and that he was unaware of which topic or context to remove the publication. "Our preliminary understanding is that the court order is challengeable in accordance with Nepal's constitution, the prevailing journalistic code of conduct and Nepal's international commitments," Bijmandu said, "We will join the legal process and respond to this matter." We are confident that the court will be responsible as usual in favor of freedom of the press.'
Nepalkhabar expressed its displeasure at the order to remove the news published on the basis of a one-sided hearing and not to write any more news about Shrestha. "We are ready to face any level of scrutiny regarding the credibility of the content we publish." We do not run away from the responsibility of accountability . We respond legally to the accusations made against us," Nepalkhabar wrote, "This order issued by the court to restrict the production and publication of more news and content on a certain subject is prima facie against the fundamental right of press and freedom of expression protected by the constitution.
