Agreement to write to Gandaki government to postpone the 'Ride Sharing' regulation
Although the then government under the leadership of KP Sharma Oli proudly announced the end of syndicates in public transport seven years ago, the businessmen brought the government to its knees by waking up the syndicate again. A working group consisting of the government and businessmen in favor of the syndicate has discussed till midnight on Monday and agreed to write a letter to the Gandaki government to postpone the 'ride sharing' regulation.
It was also agreed that the working group will inform the Ministry of Physical Infrastructure and Transport about the agreement, the Ministry will send it to the Prime Minister and Council of Ministers Office, and the Prime Minister's Office will write a letter to the Gandaki government for postponement.
Even though there is an agreement with the federal government, the National Federation of Nepal Transport Professionals has said that if transport is stopped, it will not be returned immediately. Federation president Vijay Bahadur Swaran has said that the closed program will be withdrawn only after the Gandaki government suspends the regulations. "Consent for the suspension of regulations will reach the state government through fast track and traffic will be resumed after the announcement of the suspension," Swaran said.
Gandaki Province has made a provision that four-wheelers and two-wheelers with registration certificates for private purposes can transport passengers like public vehicles.
Monday short, medium and long distance public transport did not run. Passengers had to suffer all day. The sick, children, women, old people were seen in the street.
To break the monopoly in public transport, the then government announced the end of the syndicate on 4 Baisakh 075. Coincidentally, even now, when Oli is the prime minister, the government has entered into an agreement with the syndicate. While the decision of the then government was to stop the registration and renewal of the transport committee which was done by the district administration office like non-governmental organizations. Now, even when the businessmen wake up the syndicate, the government has become innocent.
According to the law issued by the Gandaki Provincial Assembly in 076, the government has now brought regulations to ensure that four-wheeled and two-wheeled vehicles with red number plates can carry passengers like public vehicles. The businessmen, who stopped public transport in Gandaki from Friday against this arrangement, stopped the service from Monday across the country.
Such actions are considered illegal by existing laws. There is a provision in the law that you cannot strike in essential services, and if you do, you will be punished with imprisonment. Subsection (1) of Section 3 of the Essential Services Operation Act 2014 states that strike in any essential service is prohibited. Public transport is also an essential service. Section 4 of this Act provides that if a person commits or participates in a prohibited strike in essential services, he shall be punished with imprisonment for up to 6 months or a fine of 200 rupees or both. But even after 4 days of the businessmen's strike, the home administration has not taken the initiative to take legal action.
Transport expert Ashish Gajurel says that it is wrong to close public transport as it is an essential service. "There are many people who use public transport to reach different places when they are sick, whether it is office or school," he says, "Stopping the service by killing those who are taking the service is bullying by the businessmen." In December 2013, Supreme Court Justices Anand Mohan Bhattarai and Anil Kumar Sinha issued a writ against the syndicate to eliminate all remnants of the syndicate and create a competitive environment in the transport sector.
According to the argument of Vijay Bahadur Swar, the president of the National Federation of Nepal Transport Professionals, that the transport sector has become unstable after the breakup of the syndicate. "Only a few vehicles are registered in the company registrar's office," he says, "otherwise, most of the companies are share members, but the vehicle is not in the name of the company, it is in the name of an individual, there is a distortion in it, after opening the company, the vehicle must be registered in the company's name."
The report prepared by the Transport Improvement Suggestion Task Force formed under the coordination of former Secretary Sharad Chandra Paudel also mentioned that the road should be opened for five years for renewal of public transport management committees and organizations. The report of the working group formed under the coordination of Paudel mentioned that such committees and organizations should be given time for renewal until 1 July 086, but this has not been implemented yet. The
committee submitted a report to the Ministry of Physical Infrastructure and Transport on 18 Jan 080 through the Transport Management Department. For the implementation of the report, the physical had written a letter to the Ministry of Home Affairs on 3 Baisakh 081. It is mentioned in the report that the renewal of the committees related to public transport operated under the Organization Registration Act has been blocked and the assets have been frozen as the necessary preparations related to the acquired assets and liabilities have not been completed. It is mentioned in the report that since the transformation process of the
committees according to the company system cannot be facilitated, the transport management from the private sector has been affected, so time should be given to renew it. "An executive decision should be made to lift the ban on associations related to public transport for the financial year 085/86 and transfer the property to the company," the report said, "The Association Registration Act 034 should be amended by adding a restrictive provision that associations in the public transport sector will automatically dissolve from 1 July 086."
It is mentioned in the report that all the public transports that are in operation and will be operated will be operated under the company within 5 years. It has also been suggested that a separate procedure should be made to regulate transport service companies, registered operators and regulators.
The Secretary of the Ministry of Physical Infrastructure and Transport, Keshav Kumar Sharma, says that the report of the Paudel task force has not been fully implemented. "At that time, the report on what to do with the property of various transport businessmen said that they should be entrusted with it. Why should they keep their hands? It was recommended that they should clear their responsibilities," says Sharma. There is no syndicate in the matter of vehicle registration and routes and it cannot be done.'
Former DIG Keshav Adhikari says that it is wrong to demand the closure of 'ride sharing', which is providing fast and convenient facilities to the common people. "Public transport is an emergency service, it should not be closed," says the official who has also held the responsibility of the head of the traffic division. "We are concerned about safety and accidents," says Tiwari, "since the state government has the authority to make laws and regulations, they are the ones who make laws and take care of many issues."
