After her husband went to Dubai for work, Mantidevi Thakur of Garuda-4 Shantoli in Rautahat took a loan of Rs 50,000 from local Anil Saha at Sayakada 3 13 years ago. As a surety, on 3rd January 2068, she handed over 4 acres of land and a small hut built on it to Anil.

Manti requested to increase the loan as it would take 150,000 as the process of going abroad was progressing. Anil said that he could not give more money. Harishchandra takes money from Jayamangal and repays Anil's debt. Harishchandra, who had previously passed on the property to Anil, directly transferred it to Jayamangal. Harishchandra flew to Dubai in August 2069. But there he neither got the job nor the salary. After a year, he returned to the country.

1 lakh 36 thousand rupees saved from abroad was returned to Jayamangal. But the house was not returned. On the contrary, Jaymangal gave the house to his wife Rita Devi on 3 November 2071. Jaymangal's family evicted the Thakur family on 25 August 2071.

'We paid the money we earned through suffering to Mahajan. There was a lot left," said Manti, "instead of returning the property, they took it out. Later, they uprooted the house and took it away. After being evicted from the house, the Thakur family started living in a room by paying a rent of 200 rupees. 

Mantidevi filed a complaint against Jayamangal at the district administration office. When the administration withdrew and discussed, Jayamangal made a verbal commitment to return the property. But on 27 Chait 2081, he issued a prohibition order from the district court saying that arresting, detaining, and issuing documents should not be done. Jaymangal has also filed a case in the district court saying that the land was stolen on 14 Baisakh. Now the Thakur family is spending a lot of time. 

On the land occupied by Jayamangal, the struggle committee Rautahat has built a house for Manti. She lives there now. Her husband Harishchandra goes to Chitwan and works in furniture. But I can't sleep all night. Sometimes I fear that people from Mahajan will come and kill themselves,' says Manti.

After repeated requests to settle the case, Sahu had a general fight. But the next day, Sahu filed another case of indecent behavior against Mandal. Since then Mandal has been living in hiding. "The amount I took from the moneylender is only 2 lakhs, I made a paper of 15 lakhs, this is how it works here," Mandal said.

Umesh Kumar Thakur of Parsa-4 in 2072, when he took a cash loan of 30,000, he paid a loan of 90,000. After 2 years of non-repayment of the loan, the moneylender changed the Tamsuk. By that time, 36 percent interest rate showed that the principal amount was 68,000, but the moneylender made a note of 2 lakh.

Thakur paid off the loan of 90,000 less than a year after making the new Tamsuk. But the moneylender did not tear the 'Tamsuk'. On the contrary, after 5 years, the creditor filed a transaction case in court. On July 30 last year, the court sentenced Thakur to one-year imprisonment and a fine. He is also hiding now.

In the absence of proof of payment of interest, Sakas

Dindayal Koiri of Susta Rural Municipality-5 of West Nawalparasi took a loan of 6 lakh rupees in 2070 with the agreement of keeping the land as collateral. Although there was an agreement to keep a blindfold, Sahu had bowed down and submitted his resignation at Malpotam, which he learned only later.

He has already paid more than 10 lakh rupees to the moneylender but still could not get rid of the debt. He filed a complaint regarding land return and meter badge on 4 October 2079 at the district administration office. But the problem has not been solved yet. Due to lack of paper (proof) of payment of interest, the creditor has not agreed to return the land.

Susta-5's Mansa Kurmi is in a situation where she can't pay the 1 lakh rupees she borrowed from a moneylender in 2070 to send her husband to Qatar for employment. The husband who went to Qatar returned after 8 months without getting the job and salary as he was told. As they could not pay the interest at the rate of 50 per cent, the moneylenders started adding the interest to the principal. Even after selling the mortgaged land, the loan was unable to be paid off, and the creditor transferred 7 acres of land to his name. But Mansa said that the creditor is asking for money saying that there is still a loan of Rs 4 lakh. 

Complaints are not heard

Hasruddin Mansuri of Kanchanrup Municipality-1 of Saptari took a loan of 6 lakh rupees from Mahesh Prasad Saha of Bhardah 10 years ago. As a security for the loan, Hasruddin transferred the six parcels of one bigha land in the name of the father Bachi Mansuri to the name of Mahesh. 

Hasruddin had returned three and a half lakh rupees within a year and a half of taking the loan. He asked for the return of the land stating that he was ready to return the remaining amount with interest. When the land was not returned, he lodged a complaint with the district police and district administration office. But there is no hearing yet. Hasaruddin has gone abroad for employment after repeated attempts have yielded nothing. Even after that, his wife Fatima Khatun is running in the police-administration.

Complaints against moneylenders

There have been 22 complaints against Phoolkumari Sah of Khadak Municipality-10 in Saptari. The police have repeatedly written to him for his presence. But he is not gone. The district police has already taken 17 cases related to meter usage against Ramdev Sah Teli of Saptari to the court through the public prosecutor's office. Ramdev's wife, son and daughter are out on bail, while Ramdev is still absconding. There are 10 complaints each against Devnarayan Yadav of Rajviraj-13 and Mednarayan Yadav of Mahdeva-3.

According to the district administration and police office Saptari, there are 2,716 complaints related to meter badges in the district. Only 34 of them have gone to court. Agreements have been reached in 499 cases, and agreement has yet to be reached in 125 cases. 2 thousand 62 applications are still pending.

Saraswati Sardar of Itahari sub-metropolis-13 of Sunsari has been fighting a case in Sunsari District Court Inaruwa for one and a half years to get back her own land. She took a loan of 4 lakh rupees from the local Mahuli Choudhary in 2074 by mortgaging 2 kathas of land in the name of her husband Bhutai Sardar for one year. While reducing the principal and paying the interest, she handed over 540,000 to Mahuli before the due date. But the land was not returned.

On inquiry, it was found that the land has been transferred from Mahuli Chaudhary to the names of two other people. It is seen in Shresta that Mahuli has named the land to Pawan Neupane. Pawan has also sold that land to Sujata Shrestha who lives in Dharan. Saraswati filed a case against Mahuli in Sunsari District Court in 2080. Due to the court process, his expenses have increased more.

Lakshmi Magar of Gularia Municipality-6 of Bardia took a loan from four people of the village in 2077 after the corona epidemic started while building a house. But because of that debt, he said, the house was auctioned. "Even the property was paid when the interest was paid to the creditor, but the loan was not finished," she said. 

Poonam Devi of Pokhria Municipality-3 in Parsa took a loan of 8 lakh rupees from the local Sanjay Rauniyar 8 years ago and mortgaged the house built on 12 dhur land. At that time, Rauniyar got 3 kapali tamsuk papers with Poonam. Poonam had already given 240,000 rupees in cash to Rauniar for an interest of 8 lakhs. Two years ago, on the initiative of the District Administration Office, both parties reached an agreement. Rauniyar agreed with Poonam to take Rs 840,000 as principal and interest.

Now Rauniyar's father Sitaram has filed a transaction case against Poonam in the district court on the basis of the hidden tamsuk. The court has cut off the full letter in Poonam's name. Now where can I get justice?" is There is also a widespread complaint that there is no hearing even when a complaint is made to the police-administration for justice in such a problem. When some victims start raising their voices for justice, they are facing lawsuits from the moneylenders.

Rukmini Choudhary, the coordinator of Sarlahi Meter Bank Victims Struggle Committee, accuses the local administration of protecting the moneylenders. "Because the local police can protect them, they are giving more pain to the victims of the case of indecent behavior even in general matters," she said.

In Sarlahi alone, 2,326 complaints related to unfair transactions have been lodged with the district police through the district administration. Only 33 of them have gone to court. 790 complaints related to unfair transactions have been reconciled. 641 complaints were filed in the district administration and 149 complaints were filed in the police office. The reconciled amount is Rs 30 crore 26 lakh 94 thousand 4s 84. After the settlement, 26 bigha 3 katha 15 dhur have been returned. The demand is still 69 crore 24 lakh 42 thousand 252 rupees, according to the data of the district police.

When banks and financial institutions do not invest in areas bordering India, ordinary people are forced to take loans from moneylenders at high interest rates. Due to non-payment of loans, common people have to become homeless and many people have to keep their land under mortgage. As the evidence is strong, most of the creditors have gone through the court process. 

2 thousand 507 complaints related to unfair transactions (meter badges) have been registered in District Administration Office West Nawalparasi. In 3 years, about 400 complaints have been discussed but no agreement has been reached. 2 thousand 54 complaints have been sent to the District Police Office for discussion. Chief District Officer of West Nawalparasi Hiralal Regmi said that although there was no discussion about unfair transactions recently, preparations have been made. 

The number of victims of financial transactions and check dishonor is 617. This is the number of people who filed complaints in the district administration and police offices. According to Suraj Karki, spokesperson and DSP of District Police Office Rupandehi, there are 333 complaints of unfair transactions transferred from the district administration to the police. Butwal's Shankar Koirala, an activist of meter abuse victims, says that there are more than 10,000 meter abuse victims in Rupandehi alone. He claims that more than 10,000 meters have been affected in Kapilvastu and Nawalparasi. The government has so far formed three commissions to solve the problem of meter-banking victims.
