The two parallel working committees of the Non-Resident Nepali Association (NRNA), which is caught in an official dispute, have become more confused due to the different support from the ruling party. Currently, two separate working committees led by Mahesh Shrestha and Badri KC are running parallel organizations claiming to be official.
On Thursday, the controversy took a new turn after the Ministry of Foreign Affairs issued a circular to the Nepalese embassies abroad giving the authority to the association led by Shrestha. While Prime Minister KP Sharma Oli has said that the working committee led by KC will be official.
The Ministry of Foreign Affairs has sent a circular to the embassy saying that the entire working committee led by Shrestha was elected unopposed from the unity convention of NRNA organized by the high-level committee formed according to the Supreme Court's mandate. The high-level committee of the union, reinstated by the Supreme Court, held a unity convention from May 20 to 22 last year.
It has been seen that two different NRNAs have been supported by the Prime Minister and Foreign Minister of the government along with the circular of Foreign Affairs. The working committee led by Shrestha is supported by Foreign Minister Arju Rana Deuba, while KC is supported by Prime Minister Oli. Minister Rana said that according to the decision of the Supreme Court and the Ministry of Foreign Affairs, the union's unity convention was held.
'We know only one nRNA. My ministry supports this," she said while inaugurating the unity convention. It is not different, it is official. This convention is for the unity of NRNA. The court has also asked to go together. There should not be too much politics in it. Let him do politics in his fraternal organization but don't come to NRNA.' Shrestha is close to Congress and KC is close to Amalene. Prime Minister Oli has been saying that since the tenure of the KC-led working committee is up to November 4, the same working committee will be official.
NRNA's case is pending in court. Forwarded from single bench to full bench. What should be decided after recognizing the elected organization that is currently being held?,' Oli had said while inaugurating the NRNA conclave held last Wednesday from the KC side, 'Since the convention was held before this, its tenure is up to October 4. Until then, this institution seems to be continuous.'
Oli has said that the people who lost from the previous convention divided the organization according to their interests. Will the 17 people who lost in the convention agree to form another organization? This is something that cannot be done. Such an organization cannot be divided for selfish reasons," he said. When the NRNA of the ruling party is separate, the stakeholders are confused. To understand how this dispute of NRNA reached here, one has to look at the series of disputes since 1st Jan 2078.
Controversy 1: Representative selection
From the first convention to the 9th convention, the dispute of NRNA had not reached the point of division. After that, the issue of who will control the NRNA drew a deep line of controversy.
Kumar Pant's working committee elected from the 9th convention could not hold the 10th convention on time. There was a dispute about whether the new working committee will choose the representatives to participate in this convention or the old one. Out of the 3600 representatives, there was a great controversy in the selection of about 350 representatives. The 81st meeting chaired by Pant on January 1, 2078, after the schedule of the convention moved from time to time, a 7-member high-level committee including Upendra Mahato, Jiva Lamichhane, Devman Hirachan, Bhavan Bhatt, Ram Pratap Thapa and Kumar Pant was formed under the coordination of the then patron Shesh Ghale. However, even the high-level committee of Ghale could not make the selection of representatives without controversy. There was no consensus among the members of the high-level committee. Because of this, both sides reached the situation of holding separate congresses.
Controversy 2: Separate
in the 10th Congress After Kumar Pant agreed to amend the constitution from the 10th Congress held on 10th and 11th Chait 2078 and make Alopalo the president, the long-standing dispute ended. At that time, all disputes were resolved when the candidates for the president, Kul Acharya, Badri KC and Ravina Thapa, agreed to be the president alternately. However, the Ghale side did not participate in it. He conducted the 10th Congress separately on 9th Chait, one day before the Congress organized by the founding party. It selected a separate working committee headed by Vinod Kunwar.
The Ministry of External Affairs authorized the NRNA led by Acharya, KC and Thapa. The Ghale party went to the Supreme Court for the official status of the convention as the coordinator of the high-level committee.
Controversy 3 : Two Working Committees in the 11th Congress
Even when the 11th Congress arrived, there was no unity between the Ghale side and the establishment side (Acharya, KC and Thapa). Instead, the 11th Congress also split between the founding parties. There was no direct voting in the tripartite contest between Badri KC, Rajendra Kumar (RK) Sharma and Mahesh Shrestha. Badri KC was elected through online voting. Sharma and Shrestha, the contestants of the chairmanship, denied that the online voting was rigged.
Another working committee was elected under the chairmanship of Sharma with the support of Shrestha Paksha. Giving themselves authority, the Sharma side filed a case against KC in the High Court. While all the cases are under consideration, on 21 March 2080, the joint bench of Supreme Court Justices Sapna Pradhan Malla and Nahkul Subedi formed a high-level committee under the leadership of Ghale to resolve the deadlock in NRNA, which is a common organization of all non-resident Nepalis.
Controversy 4: The Supreme Court's second order
While the high-level committee was sitting waiting for the full judgment of the Supreme Court, the joint bench of Supreme Court Justices Til Prasad Shrestha and Tek Prasad Dhungana ordered the Ministry of Foreign Affairs not to stop the working committee of Badri KC from functioning. The KC party has decided to hold the 12th International Congress and World Conference in Kathmandu from October 11 to 14. Since
, the Supreme Court's judgment implementation directorate has been writing to the secretariat of the Non-Resident Nepali Association, urging the high-level committee led by Shesh Ghale to hand over the secretariat for election purposes within 7 days. The Supreme Court has also directed the Ministry of Foreign Affairs to appoint a first-class officer to facilitate the transfer of the Secretariat of NRNA. In order to implement the order of the Supreme Court, on October 1, the Ministry of Foreign Affairs took a ministerial decision and sent a letter to Shesha Ghale to proceed with the unity convention.
While the decision of the Supreme Court was being reviewed by the Directorate of Implementation, the Ministry of Foreign Affairs, through the Attorney General's office, petitioned the Supreme Court to extend the period of 6 months to the high-level committee, saying that the union's unity should be long-term through the proper and effective implementation of both decisions. The order of the Supreme Court was not issued on the petition.
Supreme Court's next order: To be submitted to the full bench
After the working committee led by Shrestha was elected from the Ekta Congress, an order was issued by the Supreme Court on May 23 to submit all pending cases related to NRNA to the full bench.
The joint bench of Justices Balkrishna Dhakal and Abdul Aziz Muslim has come to the conclusion that it is appropriate and necessary to interpret the law and adopt certain legal principles to create a certain judicial opinion on whether to allow a full unity convention to be held according to the judgment of 079-70-1507 or whether the International Coordination Council (Working Committee) formed under the chairmanship of KC until October 4, as stated in the case of 080-70-1157, will be able to act. It was decided to submit it to the full bench of the court.
While waiting for the order to come from the full bench, the superior side is excited by the circular of Foreign Affairs on Thursday. The KC side comments that the letter sent by the Ministry of Foreign Affairs to the embassy has no meaning. Hemraj Sharma, senior vice president of KC party, said, "When the Prime Minister and the Foreign Minister themselves carry the NRNA of their respective factions, we do not have to believe that the ambassadors appointed on the recommendation of those leaders will accept the ministry's letter as a basis."
