The Attorney General's Office has decided to file a fraud case against the embezzlement of the land of the children's temple in Naxal. Children's organization first entered into an agreement on 26 Baisakh 2049 to lease 9 ropani land and house/floor of plot number 760 in the name of Brihaspatisag organization until 10 January 2053. The annual rental rate of which was 42 lakh 16 thousand 608 rupees. There was also a promise to give a 20 percent discount on the rental amount if paid in advance. According to the agreement, the details of the rent paid by Brihaspati are not visible in the organization's records, the authority source said. However, the children's organization extended the agreement by 5 years.
Bal Sangathan seems to have given an additional 5 ropani 2 annas of land to Brihaspati through a supplementary agreement with an increase of 10 percent on the previously fixed annual rent on 8th June 2058. While Brihaspati sent a letter to Bal Sangathan on 6th January 2057 asking for only 2 more acres of land. The supplementary agreement was signed by the then director Rajeshwar Niraula on behalf of the organization. At that time, the annual rent of the land that Brihaspati was enjoying was 30 lakh rupees.
Brihaspati proposed to Bal Sangathan on 21 July 2059 to take additional 13 ropani land with a lease term of 30 years and a monthly rental rate of 480,000 rupees. The Central Committee meeting of the Children's Organization held on July 30 authorized the General Secretary Ramkaji Kone to enter into an agreement to lease the land of 13 ropani 12 annas 1 paisa under lot number 760 to Brihaspati for a period of 2088. This time also it was confirmed that Jupiter would get 12 annas and 1 paisa more land than asked for.
As per Brihaspati's proposal, the agreement was authorized to increase the rent at the rate of 5 percent in 2 years, not to increase the rent in the first and last 5 years, and increase the property of 50 million within 15 years. Based on that, on August 11, 2059, an agreement was signed between the organization and Jupiter for 30 years. The agreement is said to be effective from May 1, 2059. The agreement was signed by the then vice president of the organization Yogendra Bahadur Shahi, general secretary Ramkaji Kone and head of administration and procurement branch Tikamani Neupane.
After that, a dispute started between the owners of the organization saying that they rented the land cheaply. After receiving a complaint in the authority, the investigation started. The authority had instructed to review the rent. But on behalf of Brihaspati Chief Administrator Murarinidi Tiwari sent a letter on 7th November 2066 saying that the rent could not be revised. Then the central working committee meeting of the children's organization decided to terminate the lease agreement of Brihaspatisag 13 ropani 12 ana 1 paisa land on 14th December 2066. The general secretary of the organization, Krishna Shankar Sah, informed Brihaspati about the decision of the meeting on 30th January 2066 and it will be implemented from the same day.
On 28th January 2016, a resource management committee meeting of the children's organization was held under the chairmanship of Subas Kumar Pokharel, consisting of Rajeshwar Niraula, Santosh Bhattarai, Krishnashankar Sah and Manohar Gopal Shrestha. The meeting decided to pass the registration and give the land returned from Brihaspati to Tarun Nirman Seva. Manoj Kumar Mishra was the owner of Tarun. Authority for land registration was given to Shah. On January 13, 2066, the government's consent was not obtained when the registration pass was given to Tarun. Although the agreement was made, Jupiter did not leave the land. After the agreement, it was revealed that the then president Vaidya also took 75 lakh rupees from Tarun.
Vaidya admitted to the commission of inquiry led by former judge Mohanaraman Bhattarai that she had taken the money to 'run the organization's expenses'. However, that amount was not deposited in the fund of the organization. On the other hand, Brihaspati went to the Supreme Court for unilaterally breaking the contract of the land being occupied. Both the parties reconciled in the court on 21st June 2072 and again it was decided to give the land to Brihaspati cheaply.
It was agreed against the law to extend the period of 43 years from 2088 to the expiry date of the previous agreement, not to extend the last 8 years, during this period, Jupiter will increase the assets of 52 crores, can give land lien and sublease and within 6 months, the children's organization will build a 2-room building. In the guise of the same agreement, Jupiter killed the land for the year 2131 through the supplementary agreement on July 3, 2072.
It is mentioned in the letter sent by the Bank of Kathmandu to the Authority and before that, that Jupiter mortgaged the land on August 26, 2075 for 300 million rupees to be repaid within 10 years and on October 1, took a renewable loan of 133 million rupees for 1 year. Out of that, 5 ropani land has been allotted for the Central Deaf Secondary School. Similarly, the investigation revealed that 2 plants are being used for vehicle parking by the authority. After the pond was expanded in the structure of the Metropolitan Police Circle Kamalpokhari, the circle was transferred from there to the 5 ropani area of the Bal Mandir complex. Apart from that 51 rupees 3 annas 13 paisa are in the name of children's organizations. Out of that 29 ropani 4 annas land is being used by Brihaspati Vidya Sadan. Brihaspati has expanded the road by breaking down the wall inside the main gate of the Bal Mandir last time.
