The government is going to make a legal system that considers rebellion against the constitution and the system as an offense against the state and punishes it severely. In the Criminal Code, 2074, the crime against the state is to be added to the crime against the constitution, democratic republic or the act of rebelling against the basic structure of the constitution.
The Ministry of Law, Justice and Parliamentary Affairs has already prepared a draft bill to amend the Criminal Code. Section 49 of the Code on Offenses against the State has 5 sub-sections under the heading 'Not to interfere with sovereignty, integrity or national unity'.
In subsection 1 of that, it is said that "no one shall collect people, weapons and materials, build a military or paramilitary organization with weapons, or engage in such activities with the intention of disrupting the independence, sovereignty, geographical or territorial integrity or national unity of Nepal".
amendment bill draft point no. 19, the subject of amendment is mentioned in Article 49 of the original code, in which it is written, "After the wording of ``disturbing national unity'' in sub-section (1) of Article 49 of the original code, the wording of ``rebelling, causing or using force against the constitution of Nepal, the democratic republic or the basic structure of the constitution of Nepal'' has been placed.
If the draft prepared by the Ministry of Law passes through the Council of Ministers and is passed by the Parliament, even a peaceful rebellion against the Constitution and the Republic will be considered a crime against the state. According to the current law, the punishment for that crime is life imprisonment.
Prime Minister KP Sharma Oli is about to amend the Criminal Code when he has said that opposition to the Constitution, Republic and Federal Democracy is not acceptable. The royalists are protesting with the demand of establishment of monarchy.
The Rashtriya Prajatantra Party, which is doing politics with the issue of monarchy, has also said that the monarchy will be restored through people's rebellion. After the violent demonstration by royalists on 15 March, Prime Minister Oli made a strong statement targeting the anti-republican while speaking in Parliament on 18 March. During that time, he warned that former king Gyanendra Shah will also be brought under the scope of action.
