In the Kulingi period, there was no agreement on the issues like chief secretary's tenure of 2 years, secretary's 4 years, 60 years of service not applicable at once, secretary's post will be maximum 50, joint secretary's post will be reduced, rotation system will be applied in the transfer.

Civil Bill: The point of disagreement, these are the blueprints finalized by the sub-committee

The parliamentarians of the sub-committee formed by the State Order and Good Governance Committee have agreed on most of the provisions to be included in the Federal Civil Service Bill. The sub-committee coordinator Dilendra Prasad Madhu handed over the report prepared by the parliamentarians with their 'reservations' on cooling period, trade union and other issues to the committee on Thursday.

 

Sub-committee coordinator Badu said that most of the provisions were unanimously resolved on the condition that the subjects with differing views of MPs can be discussed in the committee. Even though the country has been federalized for a long time, due to lack of civil law, administrative federalism has not been implemented. 

Rather than the thoughts of the members of the subcommittee, due to the self-interest of the high-level employees, the subcommittee was forced to finish the discussion on the bill to regulate the formation, operation and service conditions of the federal civil service . However, the sub-committee submitted a report to the committee without concluding all the issues. Coordinator Badu informed that some issues have to be discussed in the committee due to their respective positions between the government side who proposed the bill, high-level employees and parliamentarians.

He said, 'All the parliamentarians have full agreement on the issues that have been agreed upon. In the sub-committee meeting, Federal Affairs and General Administration Minister Raj Kumar Gupta proposed to divide the 'cooling period' into two types, one and two years.

He proposed a cooling period of one year for government and constitutional appointments and two years for working in international organizations. In particular, the opposition MPs have demanded that it should be two years in all areas. At least one year will happen. But the issue of two years will be discussed in the committee," said Badu, coordinator of the sub-committee.

Most special category employees are in favor of not having a cooling period  are . It was agreed to keep the cooling after there was a complaint that he had quit his job to be appointed to a government or constitutional body without retiring and increasing his relationship with the leader. MPs seem to agree on that . The high-level employees including the secretary are against the cooling period . It has been agreed not to send an additional secretary because it has been agreed that the post of provincial secretary will belong to the province.

It has been agreed to send senior joint secretary (twelfth level) to the province. It has been agreed to send the provincial secretaries and chief administrative officers of the local level from the association until the province prepares the staff according to their posts. It will be sent like this for a maximum of 10 years . It has been unanimously agreed to keep the period of retirement in civil service at 60 years. Those who have reached the age of 58 at the end of the financial year in which the law is implemented by the government will be automatically retired. Those who reach 59 in the next financial year will retire . From the third financial year, the period of 60 years will be fully applicable. 

Secretaries' terms of office are two and four years 

The sub-committee has agreed to reduce the service period of the chief secretary and secretary. It has been agreed to do 2 years of the Chief Secretary and 4 years of the Secretary . In the beginning, the MPs were arguing that the service period of secretaries should be kept for 3 years . At present, the chief secretary has 3 years and the secretary has 5 years . It has been agreed to keep an additional secretary and reduce the number of secretaries. There are 52 departments across the country, and it has been agreed to keep at most 27. Many additional secretaries will be kept in the department, while the existing posts in 6 ministries will be reduced by one secretary.

There will be one additional secretary in the ministry which currently has two secretaries. The post of secretary is currently 70, but preparations are being made to increase it to 50. But the decision of how many additional secretaries and secretaries will be placed in which departments and offices will be determined by the government by conducting an Organization and Management Survey (O&M). According to

Badu, it is arranged that O&M should be done within three months of the implementation of the Act. Although the number is not specified in the law, it is estimated that the new post of additional secretary (thirteenth level) will be only 30 to 35 . The parliamentarians said that the government will not increase the number of posts as much as possible to reduce the government expenditure as much as possible.

It has been agreed that the additional secretary will be able to stay in the said post until he reaches his age . In the sub-committee, a partial agreement has been reached on trade union rights in the existing system. The issue of trade union is going to be concluded only after committee discussion. 

The sub-committee has agreed to completely close the entry of the open joint secretary . As the government proposed to keep 10 percent, the sub-committee decided not to keep it. The 10 percent is matched by internal promotion and inter-level competition. Now, 15 percent of the joint secretary positions will be filled by inter-level competition and 85 percent by promotion. Open competition for deputy secretary has been maintained. The service entry age for women has been reduced by one year to 39 years.

Men's has been maintained for 35 years . The age of women has been reduced from 40 to 39 to adjust the period of pension as they retire at the age of 60. By adding employees to their current leave  It has been agreed to give domestic tourism holidays. But the determination of how many days of leave will be given will be done by the government by making a law. Such leave is given for the promotion of domestic tourism. A person who has taken a leave has to travel around the country . The report of the place visited should be submitted to the office where he works.

The sub-committee has agreed on a provision of non-transferability for at least two years to make the transfer predictable and linked to performance . The sub-committee has agreed to fix the period in the law itself. District and local levels will be classified into A, B, C and D categories. Arrangements will be made in the law to move the transfer to a cyclical system . The employees sitting in 'A' will be sent to 'D' .

'D' will be sent to 'A' . Likewise, a mandatory situation will be created by law so that one employee must go to all areas. Coordinator Badu said that it is expected that the trend of employees not going to remote areas and random transfers will be stopped. The sub-committee will rank the posts of civil service employees at union, state and local levels.

Due to the reasons mentioned in the constitution, the word "rank" in the union will be distinguished to address which level and which category. But only the local level and state level will be mentioned.  To systematically discuss the Civil Bill, the State System Committee formed an 11-member sub-committee with MP Badu as the coordinator on February 9. In the

sub-committee, Congress' Ishwaridevi Neupane, UML's Raghuji Pant and Leelanath Shrestha, Maoist's Hitraj Pandey, RSVP's Dr. Chanda Karki, Wise Tamang of RPP, Ashok Rai of JSPA, Prakash Adhikari of JSPA Nepal, Rajendra Pandey of United Samajwadi Party and Sarvendranath Shukla of LOSPA were members. It is expected that the committee will also approve the decision made by the sub-committee, which has MPs from all parties.
